House, yesterday afternoon, where, in the presence of the clerk of the Crown, they swore to the following affidavit, in answer to the petition of the U.8.Government, to quash the writ of habeas corpus: 1.I am the petitioner for a writ of habeas corpus in the present case.9.On the 5th day of March last I amv.ed at the city of Quebec and have taken up my domicile in said city and intend to retain it therein.3.On the 15th of May last 1 waa arrested under the following circumstances: On the morning of the 15th of May last 1 was in the Hotel Chateau Frontenac, at Quebec, when one McLaughlin, of Montreal, who represented himself to be a peace officer, came to me and arrested me, under the supposed authonty of the warrant produced in this case.Upon my enquiring be fore what judge 1 was to be brought, he told me that it was Judge Chauveau.I then asked him to allow me to take my over- cost, which he refused, and he pushed me into a cab, where two other constables were sitting.The cab then started for the lower town, and [ then screamed to a friend of mine, whom 1 saw on the street, telling him that I was being kidnapped.McLaughlin then put his hand on my mouth to pre vent me irom calling.In a few minutes we reached the Richelieu wharf, and 1 was vi0- lently pushed into the boat, where | found Captain Greene.Steam was np and we left immediately.We reached the ac ctsed, alwo filed hus reply to the petition of the United States Government to quash the wnits of habeas corpus.By his reply counsel for accused alleges that the writ of habeas us was issued by Ju.ge Am- rews, who bad full jurisdiction in the matter; that accused were %iclently carried away from ther domicile at Quebet, \u2018en 15th May last in virtue of a warrant ile cally issued by U.Lafontaine, of Montreal: that immediately ailer their arrest they were illegally imprisoned and detained by Carpenter on boar! the Spray, and conveyed to Montreal; that Carpenter havi refused to eubreut to the first writ ss ani then decided that the accused were no longer in his charge; the accused then found themselves in the hands of the Montreal municipal police, without knowing who petitioners were deceived when arrest ed at Quebec, being led to believe that ther were going to he hrrught before a Quebec judge, while in reality immediately after ther arrest they were placed on beard the tug Spray.without granting them leave to see their counsel, and conveyed to Montreal: that when the writs of ha corpus were issued the petitioners were still in the limits of the district of Quebec; that the wnts of habeas corpus.firetly, issued were not served.because Carpenter and the mon accompanying hum refused to stop the Spray.opposite Three Rivers, although #0 required to do by High Constable Gale: that Carpenter himself admitted that all the proceedings were taken to prevent the petitioners from having re course to ha corpus proceedings: that in Montreal the accused were on allowed to communicate with their at midnight, on the intervention of Ald.Lebeuf: that the only object in taking the proceedings at the time and since the arrest of the accused were to take them away from the jurisdiction of their domicile; that the motions made to eet amde the writs of ha- beas corpus were illegal and null, and were not made by any party authorised so to do; that the present
