deluged this morning with claims for damages for floodings on \u2018account of the phenomenal rain fall last night, - Hundreds and hundreds of stores and dwellings were flooded.According to statistics at the City Hall there has not been such a rain fall since 1885, when in thirty-six hours a little over three inches of rain fell.But last night Practically three inches.of water fell between the hours of twelve and three.Mr.\u201cGauthier, of -the Fire Alarm Department, who takes \u2018the temperature, rainfall, etc., says\u2014the rain last night was one of the , heaviest falls he remembers ever happen- ee \"ing in the city.According to his measurement about three inches feil.\u201c ROADS WASHED OUT.\u201cThe City Surveyor said this morniug that roadway on Cote des Neiges Hill, and on St.Lawrence street, between Sher- Pooks and Ontario streets was practically washed away.From the claims for damages it is shown that houses and stores were flooded in all parts of the city.The streets that suffered the most severely were St.Catherine, both east and west; Colborne, Wellington, Common, Chaboil- lez square, Notre Dame street, Metcalie street and many streets in Hochelaga Ward.In fact, except in the very high portions of the\u201d city, there was floodings biz buildings flooded ia uilding, Murphy\u2019s store, the Sota Storage building on Wellington street, the London House, the heard with much satisfaction by real estate owners, and by taxpayers generally,that there is a likelihood of more civic improvements next year, without an increase of the consolidated debt.This news was made known to a representative of the Star, this morning, by Ald.Laporte, chairman of the Finance Committee.It has been.known for some time past that the leaders of Council were considering plans whereby civic government would be much bettered in 1902.The impression had got round .that the contemplated improvements next year, which are numerous, would be the result of an appeal rmission to in- ease the consolidated debt, which to-day standa at twenty-seven millions.WILL NOT GO TO THE LEGISLATURE Upon being asked this morning if numerous improvements were coptemplated next year, and if the consolidate: debt'was to be made .still more heavy, Ald.Laporte repue \u201c Any fear that we shall go to the Legis lature for power to increase our present consolidated debt is without foundation.Personally I feel the debt is heavy enough, and that it would be unjust to force increased taxation upon real estate owners by such.a high-handed proceeding.As to improvements, next year, yes, many are contemplat » \u201cHow.can \"they be effected without increasing the borrowing power?\u201d \u201cIn the first place we hope to have a natural increase of some three million dol- lare next year m real estate.If we are not disappointed in.this;it will mean that, according to the charter, we can borrow three | hundred thousand dollara upon the increase for permanent improvements.Then again a echeme is favoured for the submission of a by-law to real estate owners, asking them to approve of a loan of say half a million for permanent and new civic worke.\u201d DEBT WOULD NOT BE INCREASED.\u201cIf this sum is voted by the real estate owners it would not mean increasin, are consolidated debt.A sinking fund wou provided for this amount, and it would be paid off say in forty years.The consolidated debt would remain the same, twenty- seven millions.There would be, of course, a small Jpecial tax for the half million, but it would be so very small that real estate owners spent upon the many permanent repairs which are needed to the streets, for the improvement of the fire service, etc.With these two amounts it might be possible, too, to erect a new Civic Hospital, put sidewalks in the city should be done away with for good.They are never seen now in any modern city.They are a constant expense on account of the repairs they .If permanent sidewalks were put down the ford.\u201d «as | APPEAL Hil AGAINST A A STE.CUNEGONDE 1 WON'T ALLOW DELIVERY IN ITS LIMITS Of Goods in a Waggon Not Licensed by it\u2014Montreal Biscuit Company Fined Therefor and Has Taken the Case to the Court of King's Bench, \u2014 An appeal was éntered in the Court of King\u2019s Bench to-day by the Montreal Bis- suit Company against s& judgment render ed last June by the Recorder's Court of St.Cunegonde, under which the Montreal Biscuit Company was condemned to pay a fine of $15 and costs, for delivering their goods to customers in that town without paying a license and obtaining permission from the municipality of the town to drive their delivery waggons through the streets of St.Cunegonde.The appeal will come on for bearing at the September term of the court, and promises to be one of the most interesting cases that has come before the courte for a long time.It is the intention of the Biscuit Company to thoroughly test the right of the municipality of St.Cunegonde to pass or enforce a by-law compelling persons doing business outside the town to pay taxes in the shape of a license for simply delivering goods to customers inside that municipality.The corporation of St.Cunegonde claims that it has the right to pass and enforco the by-law in question under the charter granted by the Local Legislature.\u2018The section of the charter, unger which the bylaw stipulating that all vehicles using the streets of the town and owned by persons residing or doing business outside the town must pay a license, says, describing what the council can do under by-laws: \u201cTo authorize and regulate the granting of licenses to carters, owners or drivers of véhicles for hiré, or to owners of vehicles\u201d used in the city for the delivery of meat, bread, milk, ice, vegetables, groceries or any other oods, effects or merchandise, whether such owners reside in or outside of the city, to provide for the good government and discipline of the drivers of such vehicles for hire; to fix a tariff of the rates they shall be entitled to charge and to punish persons who use vehicles and re fuse to pay the fare established by tariff.\u201d In takin ppeal againat the judgment of the Recorder e Court of the city of Ste.Cunegonde, compelling it to pay a fine for delivering goods within the confines of the municipality of Ste.Cunegonde without first obtaining a license to do so, the Montreal Biscuit Company will plead that the by-law upon which this fine was imposed is \u201cultra vires of the corporation of Ste.Cunegonde, and that as non-residents of the town duly licensed to drive delivery waggons by the ration of the city of Montre in which the company does.business, it is ex- |.from the \u2018license imposed by pane municipality of a city in wi the com does not do business beyond the incléantar eliverv of goods to its customers.The head offices of the Montreal Biscuit Company are in Montreal, where the company carries on its business.It has mo branch in the city of Ste.Cunegonde.All its teams are kept in the city of Montreal, and there is no Divers branch of the company in Ste.Cunegonde.During the year 1808 several cases similar to the present came up before the courts in Montreal.It seems that the charter of the municipality of St.Henri gave that corporation power to tax both residents and non-residents much the same as the charter of the city of Ste.Cunegonde does.Under these powers the corporation of St.Hen passed a by-law levying an annual tax uj certain.persons resident and non-resident.The by-law was much tbe same in many cte as the one in question adopted by the municipality of the city of Ste.Cune- sonde.Under this by-law two actions were taken in the Circuit Court, in the city of Montreal, one against the Christie Brown Biscuit Com ny and the other against the Montreal Biscuit Company, for amounts due un- _this_by-law.These-actions were both contested on the ground that the defendants being non-rerident and not
