désigne un salarié qui, comme employé dans l'établissement d'un maître-fourreur, n'a pas terminé effectivement la période prévue dans les différents articles du décret ayant trait à l'apprentissage; l'employeur peut lui demander n'importe quelle sorte de travail, pourvu qu'il ne soit pas habituellement employé à des travaux d'une classe supérieure à celle pour laquelle il est payé.Tout apprenti employé plus de la moitié de son temps chaque semaine à des travaux d'une classe supérieure à la sienne, doit être rémunéré pour chaque heure au taux de la classe dans laquelle il travaille.L'apprenti doit avoir seize (16) ans révolus.c) Pour devenir un \"coupeur qualifié\", le coupeur doit avoir travaillé effectivement au moins trois (3) ans dans ce genre de travail.Si, après cette période and amendments) with, however, the following new provisions to be substituted for the conditions described in the Quebec Official Gazette, issue of April IS, 1953: I.Definitions: a) In the decree, the term \"master-furrier\" or \"fur retailer\" means any person whose occupation consists in producing and selling, by unit, fur coats and any other fur articles; in making himself, in his shop, the said articles to be sold directly to the customer or consumer; in making for customers the repairing of any fur articles.b) In the decree, the word \"apprentice\" means an employee who, as employee in the establishment of a master furrier, has not actually terminated the period established under the various sections of the decree concerning apprenticeship; the employer may request from him the execution of any kind of work provided he is not habitually employed in operations of a higher class than that for which he is paid.Any apprentice employed more than half the working time each week in operations of a higher class than his, shall receive the hourly rate of the class in which he is working.The apprentice must be at least sixteen (16) years old.c) To become a \"qualified cutter\", the cutter must have effectively worked at least three (3) years in such operation.If, after the said apprenticeship period, the apprentice has not acquired the skill required to become a qualified cutter, he may request from the Parity Committee an authorization to carry on such work during twelve additional months at a rate of pay determined by the said Committee.II.Jurisdiction: a) Professional jurisdiction: 1.The provisions of the decree apply to establishments represented by the contracting party\" of the first part, to private concerns that signed the agreement and to all retail fur merchants operating within the territorial jurisdiction described in subsection \"b\" of the present section and to all employees, qualified workers and apprentices in their employ.2.The decree does not apply to the fur trimming and dyeing industry; neither does it apply to establishments doing work connected with the said industry.Proviso: Should there be difficulties as to the subjection of a retail merchant engaged at the same time, in wholesale business and having signed both agreements, the conciliation officer of the Department of Labour shall have the right to determine the decree by which the said retail merchant shall be covered.b) Territoriahjurisdiction: The territorial jurisdiction of the decree comprises the Island of Montreal and a radius of fifty rémunéré à raison de salaire et demi, excepté durant les mois de septembre, octobre, novembre et décembre, où il est permis à l'employeur de faire travailler ses salariés une semaine de quarante-quatre (44) heures, au taux régulier, en deçà des heures indiquées plus haut.Nonobstant les dispositions de l'alinéa précédent, un salarié qui se rapporte en retard à son travail par sa faute doit compléter le nombre régulier d'heures de travail pour ce jour, avant d'être rémunéré à raison de temps et demi.Les employeurs peuvent cependant, par tolérance spéciale, garder à leur service, le Cependant, les employeurs faisant affaires en dehors de l'Ile de Moutréal, ont droit à la semaine de travail de quarante-quatre (44) heures au taux régulier mais demeurent assujettis à toutes les Saint-Jean-Baptiste et à la fête du Travail pourvu que l'employeur obtienne l'autorisation écrite du Comité paritaire à cette fin.Cependant, pour avoir droit à ce congé payé, les salariés doivent avoir travaillé au moins une partie de la semaine où ledit congé tombe, et dans ce cas, le salarié doit recevoir pour ce jour une rémunération proportionnée à la durée de son travail pour une semaine de quarante (40) heures.Le salaire dû par l'employeur à ses salariés pour ces jours de fête est celui que les salariés auraient reçu si l'atelier avait été ouvert ce jour-là et si les salariés y avaient travaillé les heures régulières réglementaires.Cette clause ne joue pas, cependant, si les fêtes plus haut décrites tombent un dimanche.Quand le jour de Noël et.le Premier de l'An tombent un dimanche, le lundi suivant est chômé et payé.Si le salarié travaille un des jours de fêtes ci-haut désignés, il doit recevoir le taux régulier de salaire, plus salaire et demi, mais en aucun cas,' un the months of September, October, November and December during which it is permitted for an employer to have his employees work a forty-four (44) hour week at the regular rate of pay within the hours above mentioned.Notwithstanding the pro visions of the foregoing paragraph, an employee late to work by his own fault shall complete the regular number of working hours for that day before being entitled to the time-and-a-half rate.The employers may, however, by special tolerance, keep a female finisher to work on Saturday morning, for the months of January and February, at straight time.The regular week of such employee shall not, however, exceed forty-four (44) hours.b) However, the employers doing business outside the Island of Montreal, are entitled to the 44-hour week at the regular rates but shall remain subject to all other provisions of the present section, inasmuch as working hours of their employees are concerned.During the months of September, October, November and December, it is permitted for said employers to have their employees work a forty-eight (4S) hour week, at regular rates of pay.IV.Remuneration on holidays: All employees shall receive remuneration for the following holidays: New Year's Day, Good Friday, Ascension Day, St.John the Baptist Day, Labour Day, All Saints' Day, Immaculate Conception Day and Christmas Day.Another day may be substituted for Good Friday, St.John the Baptist Day and Labour Day provided the employer obtains written authorization from the Parity Committee to that effect.However, to be entitled to this paid holiday, the employees must have worked at least part of the week where the said holiday occurs and, in this case, the employee shall receive, for this day, a remuneration based on the proportion of his hours of work with respect to a forty-hour week.The wages owed by the employer to his employees in regard of these holidays shall be that which the employees would have received if the establishment had been open that day and if the employees had worked the regular hours.This clause does not apply, however, when the holidays above described fall on Sunday.When Christmas and New Year's Day fall on Sunday, the following Monday shall be kept as a holiday.Should an employee work one of the said holidays, he shall receive the regular rates of wages plus time and a half but an employer shall never compel his employee to work on such days.Should the establishment close in the course of the week wherein there is a holiday, the employees shall receive their complete wages such holiday.V.Special definitions: a) For each operation, the number of employees of class A shall represent at least 50% of the number of employees for said operation.Should the employer be forced to reduce his personnel,
