and carried away in a state of insensibility.The carter was sitting on the left hand side of his truck ; he was driving in the direction of the canal, and must have seen the deceased.By deceased was not struck a minute until I saw him ; when I saw the deceased, his head was lying in the direction of the canal ; after the prisoner\u2019s truck struck the deceased, he drove off as fast in charge of some cattle ; it was a market day ; Sullivan, the deceased, wished to drive his cattle up King Street; the carter was sitting on the right hand side of the truck when the deceased was struck ; the back of the prisoner was turned to the deceased, and had the attention of the carter been turned to his horse, he must have observed the man before he was struck ; there being cattle in the street at the time, the attention of the prisoner might have been turned in that direction ; the deceased was about ten feet from the foot-path, but the cattle which he was driving being in the way of the carter, the latter would have to make a kind of turn to pass by him.By Air.Cassidy\u2014I could not say that I saw the deceased struck by the shaft; but I saw him struck by the wheel.The deceased, when he met his death, was driving two cows and fifteen sheep.He was a strictly temperate man.The horse of the carter was going at a speed over an ordinary trot.The distance from the place the 26th of August last i witnessed an accident in Common Street.I saw the carter coming along at a quick trot.The carter was sitting on the left side of the truck ; the deceased was also on the same side of the road.The deceased was first struck by the shaft of the truck, and knocked down by the wheel.The deceased, when struck, was moving along with his cattle.Had the attention of the prisoner been given to his horse he must have seen the deceased.I went to the deceased after he fell.He was insensible ; but I do not know if he were dead.I believe he died the next morning.By Air and six o\u2019clock in the evening of the 26th.He was insensible.There was a small quantity of blood on the scalp, but no injury on the skull.I visited the deceased a second time between six and seven o\u2019clock.I did not feel called upon to treat him medically ; he remained insensible till he died.I attended the post mortem.Air.Alonk\u2014What did you then see ?Dr.Hingston\u2014Alay it please the Court; I had a conversation with the Crown Officer yesterday, and I was informed that medical men were not to be remunerated for their loss of time in giving evidence; therefore, medical knowledge being private property, I would wish, under these circumstances, to withhold it.Judge Aylwin\u2014You will give your evidence, Dr., in this case, as you are only an ordinary witness.Dr.Hingston\u2014There was a small quantity of blood found in the right side of the skull ; the skull was not fractured.The kidneys were somewhat injured.The deceased met his death from compression of the brain.The external wounds on the scalp were, I think the cause of death ; they caused, no doubt, compression of the brain.They deceased must have been a healthy man.By Air.Cassidy\u2014The woends on the body were over the right and left kidneys ; but death was caused by compression of the brain, which in turn, might have been caused by falling on the street.I cannot state whether or not the man was struck by the shaft of the cart ; the wounds were not exactly such as a shaft would make.Dr.Jones examined by Air.Monk\u2014You have heard the evidence, and what, in your opinion, was the cause of'death?Dr.Jones\u2014My medical knowledge is my source of livelihood, and without remuneration I beg leave to refuse my opinion.Air.Monk\u2014This question ought now to be settled, and I submit that Dr.Jones is bound, like any other witness, to give his opinion when called upon.Dr.Jones\u2014You would then punish a man for acquiring his profession.Judge Aylwin\u2014This matter is one of very great importance.It is a question whether the Act passed last session will bear the construction that other witnesses are to be remunerated, while medical witnesses receive nothing ; or it is a question, whether even in view of this act, the court has not power to order the Sheriff to give such compensation as the medical man may himself demand.It is a question whether the Court ought to order medical men to appear to give evidence unless there is a certificate from the crown officer as to the materiality of the testimony.Grand Jurors are paid, petty jurors are paid when brought from the country, and it would seem somewhat strange that medical men who, like lawyers, acquire their profession laboriously and expensively, should receive nothing for their opinion.The time of a medical man may he valuable ; his practice may be very extensive, and it must appear to be simply unjust that he should be compelled to place both at the service of a court, and all for nothing.However, there is this much in the matter that when a medical man is called upon by the coroner to open a body he cannot be compelled to comply with the command, unless he be promised a compensation.Air.Monk,\u2014That would be a question of contract.Judge Aylwin.\u2014No ; it is a question whether doctors by the recent act are not entitled to compensation; this question,however, may soon be set at rest, for the court, though it may now withold its opinion will take a speedy opportunity of inquiring what are the real merits of the act, and its real little produce shipping,as prices are higher here than in Britain.There has not been much business done by Auction during the week, but there are several trade sales advertised for next week, which should draw buyers from all parts.Sugars are still dull.Prices, however, have varied but little for prime Grocers, while inferior and refining grades] have declined.Sales of over 60 hhds fair to
