[" Car kills woman aged 3/ An 87-year-old woman, Miss Elda Fee, 400 Lansdowne avenue, was killed instantly when she was struck by a car as she crossed Sherbrooke street from south to north at Arlington just before seven o'clock Saturday evening.Miss Fee was the victim of Westmount's second fatal pedestrian accident of the year.The other was Feb.16 when Charles Herzberg, 76, of 250 Clarke avenue, was killed in a hit- and-run incident as he crossed de Maisonneuve boulevard at Clarke avenue.Westmount Police are still seeking a red Camaro which they believe hit Mr.Herzberg.Miss Fee was struck by a 1970 Chevelle driven by Stanley Dmuchalsky, 50, of Ste.Dorothee in Laval.Mr.Dmuchalsky said he saw Miss Fee stanaing on the street just off the curb as he proceeded west on Sherbrooke.Walked into car path As he approached, she walked out into the street and was struck by the front of the car.She was thrown onto the hood of the vehicle before falling to the street.Two doctors were in the area of the accident and they pronounced her dead at the scene.Miss Fee first came to West- mount in 1928 and until 1940 she lived at 314 Roslyn avenue.She then moved to N.D.G.but returned to Westmount over two years ago and lived at 4557 Sherbrooke street before moving to 400 Lansdowne in April of this year.Although she lived in N.D.G.for many years she kept up her Westmount acquaintances and since 1928 was a member of Westmount Park United Church.With Travellers\u2019 Aid She worked for many years with the Travellers\u2019 Aid of the YMCA and was involved with many auxiliaries including those of the Montreal Association for the Blind and the Catherine Booth Hospital.The fatal accident on the first day of July brought to an end a month of almost in recent months have used council meetings to attack and debate various causes and personalities.Ald.Douglas Robertson was most vehement in his criticism of persons who come to the meetings and use their right to speak in the wrong way.\u2018\u2018Those who speak here should not personally attack other citizens or aldermen,\u201d he said.\u2018\u2018Personalities should be left out.\u201d Ald.Robertson's comments came as a result of several recent meetings where various groups have attacked each other and city council from the floor of the city hall chambers.They were touched off Manchester, England, who was brought up and educated here, graduate from McGill University in 1932 as an engineer and was one of the most prominent members of his RSS; Irving Backler profession among Council agonizes MAYOR Ouimet and his council are agonizing over the extent of the City of Westmount\u2019s responsibility in problems , of a social nature.Well they might agonize.Not inconsiderable pressure is being applied in successive waves for this project and that, embracing people of most every age group and circumstance.Well they might agonize.Westmount is the exemplar of good local government; other municipalities are watching to profit by our experience, perhaps follow our lead.Well they might agonize.Despite its reputation, Westmount is not inexhaustibly wealthy; local taxation is at or near its limits, is faced with the more immediate costs of the MUC.The city is in an unenviable position: it will be damned if it does and damned if it doesn\u2019t.Regardless of all the study now laun- ched\u2014much of it of the precedents in other cities\u2014the final crunch is going to come from a determination of which side would damn council the most: proponents of social undertakings or property owners, sympathetic to these undertakings or not who feel they can pay no more.Someone has suggested a plebiscite.Others have suggested a plebiscite would kill any such adventures.If that is a valid determination, it should be kept uppermost in council's mind.Council represents the taxpaying electorate first and foremost, before any other group in the community.Which does not, of course, wipe away the validity of any or all of these projects.The question seems, more properly, one of jurisdiction.Main thrust of the city's study well might pursue this line.Indeed, council should ask itself if by going into \u201c\u2018social\u2019\u2019 projects it is not in fact preempting quite clearly the role assumed, with recently mounting vehemence, by the provincial government.Many government functions are best directed locally, which goes for most traditional municipal services.Others require broader bases\u2014health services, for example, which do not easily conform to municipal boundaries.Surely the 4424 Clinic belongs more properly in some modified slot of Quebec's hospitalization and medicare system that it does in a new extension of city services.There is going to be no quick or easy solution.Emotions are brought into play, understandably by those genuinely concerned.But the course council now charts is too fundamental for that kind of influence.Practicalities must prevail.Bad legislation The motives of Justice Minister Jerome Choquette are admirable\u2014to wipe out any organized crime in the province.But his proposed methods are alarming.An investigative body empowered to search and seize on its own warrants, without being required to justify its intended action before a member of the independent judiciary, must be eyed askance.Crime, organized or otherwise, should be balked at every possible turn to protect society.But time-tested safeguards to protect society from abusive authority are just as vital to the citizen's well- being.As we read Mr.Choquette\u2019s proposed legislation, there is nothing to prevent over-zealous, mis-informed or malicious investigators invading our offices or home or your offices cr home, combing through them at will and taking away what they wish, to the detriment, discomforture, dislocation and damage of any citizen, good or bad, criminal or law-abiding.That is bad legislation.Many happy returns CITY Council should eat more birthday cakes before its meetings.They spoke a lot of sense Tuesday night.And they elicited some good advice.Clearly enunciated was the oft-sublimated principle that they are elected to do the city's business according to their best judgment, that they should command respect in return for lending sympathetic and understanding ears, and that the council chamber should be .subject to the same rules of decorum whi Former Mayor Peter McEntyre will be remembered for appealing to citizens to show their interest in the work of council by coming out to its meetings, listening intelligently to the proceedings and contributing wisdom and guidance to deliberations.He really didn\u2019t succeed.The city is too well run.Perhaps citizens have more abiding concerns.Mayor Paul Ouimet has been more successful in attracting people to \u2018his govern other legislatures: ~~~ * Mackings.Uhfortinatély rhary-0f fese Hon.C.M.Drury says.The fallacy of the surtax I am still receiving queries about why the federal government chose to prolong the surtax beyond Jan.1, 1973, and why the minister of finance, Mr.Turner, chose not to mention this in his budget of May 8.In point of fact, the change due to occur at the end of the year is being confused with a surtax that applied between 1968 and mid-1971.Unfortunately, the opposition and some newspapers have referred to the change as a \u201c\u2018tax increase,\u201d and so I think it is worth taking this opportunity to clarify the situation.In 1968, 3 per cent surtaxes were introduced to parliament on personal as well as corporation income taxes as part of the federal government's anti-inflationary fiscal measures.Although they were to apply only to the end of 1969, they were extended twice, on the first occasion to the end of 1970, and later to the end of 1971.Surtaxes were ended However, in June 1971 the then minister of finance, Mr.Benson, announced in his budget that both surtaxes would terminate on July 1, 1971.This announcement went into effect on that date, and there have been no surtaxes on the income of either Canadian individuals or corporations since the middle of 1971\u2014over a year ago.So much for the surtax.On Oct.14, 1971, Mr Benson announced temporary tax cuts of 3 per cent for individuals and 7 per cent for corporations, In each case, they were to last for an 18 month period which was due to expire at the end of 1972.These measures were finally given legislative approval by parliament in March this year.No mention was made of this expiry in Mr.Turner's recent budget speech for a number of very good reasons.First, the enabling legislation which authorized its termination had been debated in the house only seven weeks earlier, and was assumed therefore to be fairly common knowledge.Second, no mention was made of other tax changes which were due to come into effect as a result of previous legislation, such as the reduced rate on the first $500 of personal taxable income, the increase in the basic personal exemption, and the complete elimination of income taxes for one million Canadians and a reduction for 4.7 million others.Discussed with press Thirdly, this issue was discussed thoroughly at press briefings on budget day and Mr.Turner in his post-budget news conference.The reason of course is that the revenues needed to achieve other priorities, such as assisting those living on HN RN Se.HE are there for reasons not suggested by anyone at city hall.Many of the visitors these days are, not to put too fine a point on it, grinders of axes and riders of hobby-horses.Their various causes are genuine enough\u2014but it is these particular causes, not good municipal government, which brings them out.Some aldermen finally reacted Tuesday night.Ald.Douglas Robertson suggested that some remarks were in contempt of council.Personalities should be left out, he asserted.Ald.Charles Aspler advised that persons who were not satisfied with those who represent them should turn them out and find new representatives.Ald.Leeds Nelson declared council the only local elected body and it was up to other groups in the city to find their own means of forming groups\u2014not come complaining to council.Mayor Ouimet said it was a very good council, as had been those before it.\u201c>< \"Cnhtinaed on page five * - *- > +\" fixed incomes and stimulating the economy without provoking inflation, could not be realized if these lower tax rates were maintained.There was certainly no attempt to pull the wool over anyone's eyes, nor to becloud what is in fact a very clear situation.Taxation measures are normally one of the most complicated issues with which governments and parliament grapple, but this was a relatively easy one to comprehend.It's unfortunate that greater effort was not made at the time to discover the facts before insinuating that the government was trying to cover up.2 Ve ueuet so that front doors would face what is now Arlington avenue.Lanes have been altered in more recent times as well.The city expropriated land and widened the lane behind the north side of Sherbrooke street between Grosvenor and Victoria avenues to help trucks delivering to stores on Sherbrooke street.The expansion of Temple Emanu-El altered the course of a lane behind Sherbrooke street between Wood and Elm avenues.To gain extra land, the Temple bought a house on the other side of the lane, demolished it and moved the lane back.Residents not agreed An attempt to build a new lane from de Maisonneuve boulevard to Sherbrooke street between Grosvenor and Victoria avenues failed when the city could not get all residents to agree to cede nine feet of their back yards to make way for it.Although the building of a lane was blocked in that case, they are very useful for the people whose homes back onto them.They are convenient for deliveries of oil and milk and for the pick-up of garbage.They also provide access to parking areas in the rear.But the residents of Elm and Wood avenues have, this summer, found another, perhaps even better use for them: a place to gather.to have a
