Whereas subdivisions 325 (part) of 1.0 acre and 327 (part) of 0.25 acre are stated in the list of cadastral subdivisions mentioned in the said Order: Whereas the copy of the deed of acquisition of these two parts by Hammermill Paper Company, granting the rights thereof to the Provincial Government, executed on 6 December 1920, stipulated that it is not a sale of lands but only a transfer of \"all riparian or other rights that the vendor has and may have and claim in or on the Matane River, fronting the.lands, known and designated under numbers .325 and 327.etc.\"; Whereas, since the transfer authorized by Order in Council 1776 dated 21 June 1972.the Department of Tourism.Fish and Game has not erected any buildings or ground installations whatsoever on these parts of lots nor carried out any land improvement work whatsoever and it is expedient to amend the aforesaid Order; en conseil.Concernant un règlement modifiant les règlements 1.2 et 3 de la Loi de l'aide sociale.Attendu Qu'en vertu de l'article 48 de la Loi de l'aide sociale (L.Q.1969.ch.63 et am.), le lieutenant-gouverneur en conseil possède un pouvoir de réglementation; Attendu Qu'aux termes de l'arrêté en conseil 3491 du 17 septembre 1970.des règlements ont été adoptés sous l'empire de cette loi: Attendu Qu'il est devenu nécessaire de modifier certaines dispositions de ces règlements: Il est ordonne' en conséquence sur la recommandation du ministre des affaires sociales: Que le Règlement du règlement 1 de l'aide sociale est remplacé par le suivant: 2.01 La valeur de l'aide pour un mois donné qu'il s'agisse de l'aide en espèce, en nature ou sous forme de services est égale au déficit, pour le mois qui précède, entre l'ensemble des besoins ordinaires et spéciaux d'une famille ou d'une personne seule et l'ensemble de leurs revenus.Les revenus hebdomadaires sont transposés sur une base mensuelle en les multipliant par le facteur 4.3 lorsque la famille ou la personne seule réalise ces revenus pendant tout le mois.2.L'article 4.02 dudit règlement est modifié en ajoutant le paragraphe i suivant: O.C.1289-73, 11 April 1973 Reg 73-191, 13 April 1973 SOCIAL AID ACT (S.Q.1969.ch.63) Present: The Lieutenant-Governor in Council.Respecting a Regulation amending Regulations 1.2 and 3 under the Social Aid Act.Whereas under section 48 of the Social Aid Acl (S.Q.1969.ch.63 and am.), the Lieutenant-Governor in Council has regulatory powers; Whereas under Order in Council 3491 dated 17 September 1970, regulations were enacted pursuant to the said Act'; Whereas it has become necessary to amend certain provisions of the said Regulations; It is ordered, therefore, upon the recommendation of the Minister of Social Affairs: That the Regulation annexed to this Order in Council amending Regulations 1.2 and 3 under the Social Aid Act.be made; That this Regulation be published in the Québec Official Gazette and come into force on 1 May 1973.Julien Chouinard, Clerk of the Executive Council.Regulation amending Regulations 1, 2 and 3 on Social Aid Division I AMENDMENTS TO REGULATION 1 ON SOCIAL AID 1.Section 2.01 of Regulation I on Social Aid is replaced by the following: \"2.01 The value of the aid for a given month, whether it be aid on money, in kind or in the form of services, is equal to the deficit, for the preceding month, between the aggregate of the ordinary and special needs of a family or individual and the aggregate of its or his income.The weekly income is calculated on a monthly basis by multiplying it by 4,3 when the family or individual receives such income for a whole month.\" 2.Section 4.02 of the said Regulation is amended by adding the following paragraph i: 1270 QUÉBEC OFFICIAL GAZETTE.April 25.1973.Vol.105, No.10 Pan 2 \u2022 i) les biens dont un enfant à charge est propriétaire si la gestion de ces biens relève d'un tuteur, d'un exécuteur testamentaire ou d'un fiduciaire qui doit en rendre compte selon la loi.3.Le paragraphe a de l'article 4.05 dudit règlement est remplacé par le suivant: ¦ a) pour ce qui touche les revenus de travail.1) ces revenus sont établis: i) en comptant l'ensemble des sommes qui le composent dont les pourboires, les bonis, les commissions nettes et le revenu net d'un travail autonome ou d'une entreprise: ii) en déduisant de ce total les prélèvements effectués pour fins d'impôt, d'assurance-chômage ou d'assurance-maladie, de même que les contributions au Régime de Rentes et les cotisations syndicales; 2) ils sont compris dans le calcul de l'aide d'après la table reproduite à l'annexe B du présent règlement, en considérant le mois de retour au travail: i) comme le premier mois de la table, si l'aide est versée depuis quatre mois ou plus; ii) comme le deuxième mois de la table, si l'aide est versée depuis trois mois: iiil comme le troisième mois de la table, si l'aide est versée depuis deux mois; iv) comme le quatrième mois de la table, \u2014si l'aide est versée depuis un seul mois: \u2014si le revenu provient d'un emploi déjà occupé au moment où l'aide est accordée; \u2014s'il s'agit d'un fermier au sens de l'annexe A du présent règlement; \u2014si le mois de retour au travail ne répond pas à la définition qui suit; 3) les règles suivantes s'appliquent aux fins du présent paragraphe: i) les mois depuis lesquels l'aide est versée doivent être consécutifs, et cette aide doit s'entendre des seuls besoins ordinaires; ii) si la table a déjà servi au calcul de l'aide d'un mois quelconque, ce mois ne compte que s'il a été considéré comme le quatrième mois de la table: iii) le mois de retour au travail signifie le premier mois où des revenus de travail sont perçus et compris dans le calcul de l'aide en vertu de la table: \"(i) property owned by adependent child, where such property is administered by a tutor, testamentary executor or trustee who must account therefor, in accordance with the Act.\" 3.Paragraph a of section 4.05 of the said Regulation is replaced by the following: \"(a) in the case of income from work.(1) such income is determined: (i) by taking into account the aggregate amounts comprised therein, including tips, bonuses, net commissions and net income from self-employment or an undertaking: (ii) by subtracting from such total the deductions made for income tax.unemployment insurance or health insurance purposes, together with the contributions to the Pension Plan and union dues; (2) such income is included in the computation of aid, in accordance with the table in Schedule B of this Regulation, with the month of return to work being considered: (i) the first month indicated in the table, where aid was granted during the four preceding months or more: (ii) the second month indicated in the table, where aid was granted during the three preceding months: (iii) the third month indicated in the table, where aid was granted during the two preceding months; (iv) the fourth month indicated in the table, \u2014where aid was granted during a single month; \u2014where income derives from a post already filled at the time when such aid was granted; \u2014in the case of a farmer within the meaning of Schedule A of this Regulation; \u2014where the month of return to work does not comply with the following definition: (3) for the purposes of this paragraph, the following rules shall apply: (i) the months during which aid was granted must be consecutive, and such aid must only include ordinary needs; (ii) where the table was already used in computing the aid for any month, such month shall count only if it was considered the fourth month indicated in the table; (iii) the month of return to work means the first month where income from work was collected and included in the computation of the aid.made pursuant to the table; Partie 2 GAZETTE OFFICIELLE DU QUÉBEC.25 avril 1973.105e année.N° 10 1271 iv) il possède cette signification nonobstant le fait que ces revenus augmentent ou diminuent par la suite, ou que l'emploi dont ils proviennent change: v) si le mois de retour au travail n'est pas considéré comme le premier mois de la table mais un mois subséquent, les mois qui le suivent sont similairement différés; 4.Le paragraphe 7 de l'article 4.05 dudit règlement est remplacé par le suivant: «7) les revenus provenant de biens dont un enfant à charge est propriétaire si la gestion de ces biens relève d'un tuteur, d'un exécuteur testamentaire ou d'un fiduciaire qui doit en rendre compte selon la loi.» 5.L'article 5.08 dudit règlement est remplacé par le suivant: 5.08 L'aide sociale est accordée à un requérant à compter du 1er jour du mois qui suit la date de la réception de sa demande à un bureau du ministère, ou par une personne ou tout organisme avec lequel le ministre a conclu un accord en vertu de l'article 49 de la loi.Toutefois, si le requérant satisfait aux normes d'admissibilité prescrites par la loi et les règlements, l'aide sociale peut aussi être accordée: a) pour le mois au cours duquel la demande a été reçue, basée sur le déficit de ce mois; b) pour la totalité ou une partie du mois qui précède celui de la demande, basée sur le déficit de ce mois, dans le cas de dénuement total.Le passage d'une catégorie d'âge à une autre d'un enfant à charge ou l'arrivée d'un tel enfant, pour les fins de l'article 3.01 du présent règlement, prend effet à compter du mois qui suit la date à laquelle le passage s'effectue ou l'enfant arrive, selon le cas.Les prestations d'aide prennent fin selon les dispositions de l'article 22 de la loi ou.dans le cas des médicaments, selon les dispositions de la Loi de l'assuran-ce-maladie.» 6-L'article 5.16 dudit règlement est abrogé.7.L'article 5.17 dudit règlement est abrogé.Section II MODIFICATION AU RÈGLEMENT 2 DE L'AIDE SOCIALE 8.Le paragraphe / de l'article 2.02 du règlement 2 de l'aide sociale est remplacé par le suivant: « f) les frais afférents à la réparation ou l'assainissement de biens immobiliers utilisés à des fins d'habitation si ces frais sont indispensables.» \u2014bureau régional: $300.(iv) such month has the same meaning notwithstanding the fact that such income increases or decreases afterwards or that the employment from which it is derived changes: (v) where the month of return to work was not considered the first month in the table but a subsequent month, the months thereafter shall be similarly deferred: 4.Paragraph 7 of section 4.05 of the said Regulation is replaced by the following: \"(7) income derived from property owned by a child where such property is administered by a tutor, a testamentary executor or trustee who must account therefor in accordance with the Act.\" 5- Section 5.08 of the said Regulation is replaced by the following: \"5.08 Social aid is granted to an applicant from the first day of the month following upon the day on which his application is received at the office of the Department or by any person or body with whom the Minister made an agreement, pursuant to section 49 of the act.However, if the applicant meets the conditions of eligibility prescribed in the Act and regulations, social aid may also be granted: (a) for the month during which the application was received, based on the deficit for such month; (b) in the case of complete destitution for all or part of the month preceding that of the application, based on the deficit for such month.The passing of a dependent child from one age group to another, or the birth of such child, for the purposes of section 3.01 of this Regulation, shall be effective from the month following upon the date on which such passing or birth occurs, as the case may be.The benefits shall terminate in accordance with section 22 of the Act or.in the case of medications, in accordance with the Health Insurance Act.©\u2022 Section 5.16 of the said Regulation is revoked.7.Section 5.17 of the said Regulation is revoked.Division II AMENDMENTS TO REGULATION 2 ON SOCIAL AID 8.Paragraph/of section 2.02 of Regulation 2 on Social Aid is replaced by the following: \"(f) costs relating to the repair or sanitary improvement of immoveable property used for lodging purposes where such costs are essential.\" \u2014regional emploi, ou permet de conserver l'usage de biens essentiels.¦> \u2014bureau régional: S200.ÎO.L'article 2.05 dudit règlement est remplacé par le suivant: ¦ 2.05 L'aide sociale peut aussi couvrir une seule fois par année, à la personne seule ou la famille, une aide équivalant à un dixième du montant mensuel versé au titre de la nourriture, du vêtement, des nécessités personnelles et domestiques et des frais afférents à l'habitation lorsque celte personne seule ou famille, durant une période d'aide, déménage du territoire desservi par le service des Affaires sociales de la Ville de Montréal à un territoire desservi par un bureau local du ministère.¦> Section III MODIFICATION AU RÈGLEMENT 3 DE L'AIDE SOCIALE 11.La classification des municipalités par zones de logement aux fins de l'aide sociale prévue au règlement 3 de l'aide sociale, est remplacée par la suivante: (1) Cette classification sera revue et amendée trimestriellement pour tenir compte de l'ouverture de nouveaux bureaux locaux et des changements ou regroupements de municipalités.(2) C=Cité VT = Ville V = Village P = Paroisse CT = Canton SD = Municipalité sans désignation RI = Réserve Indienne TNO=Temtoire non general manager of a hospital centre, appointed in accordance with sections 69 to 71 ol the Act respecting health services and social services (S.Q.1971.ch.48); (j) \"agreement\": an agreement concluded in accordance with section 5 of the Act; (k) \"Federal hospital\": a hospital or hospital centre owned or operated by the Canadian Government; (I) \"Act\": the Hospital Insurance Act sont médicalement nécessaires.3.Les services assurés sont les suivants, lorsque fournis sur ordonnance médicale et, si nécessaire, sous surveillance médicale adéquate: a) dans le cas de bénéficiaires hébergés dans un centre hospitalier pour y recevoir des traitements: i) le logement dans une salle et les repas; ii) les soins infirmiers nécessaires; iii) les services de diagnostique pour maintenir la santé, prévenir la maladie ou aider au traitement de toute blessure, maladie ou infirmité, y compris les interprétations nécessaires pour les travaux de laboratoire ou de radiologie; iv) la fourniture des médicaments, prothèses, orthèses, produits biologiques et des préparations s'y rattachant à la condition qu'ils soient nécessaires suivant l'avis d'un médecin et qu'ils soient administrés dans le centre hospitalier; toutefois, la fourniture de préparations vendues sous l'autorité de la Loi concernant les spécialités pharmaceutiques ou médicaments brevetés (S.R.C., 1970, ch.P-25) n'est pas un service assuré au sens du présent règlement; v) l'usage des salles d'opération, des salles d'accouchement et des installations d'anesthésie, avec l'équipement et le matériel nécessaire; vi) la fourniture du matériel de chirurgie courante: vit) l'usage des installations de radiothérapie; viii) l'usage des installations de physiothérapie; ix) les services rendus par le personnel du .Le directeur général de tout centre hospitalier doit transmettre au ministre, selon la formule produite en annexe B.un rapport sur toute personne s'étant présentée au centre hospitalier pour y recevoir les services énumérés aux sous-paragraphes i à ix du paragraphe/» de l'article 3.Ce rapport doit être transmis au ministre dans les 4 jours de la fourniture du service.20.Le ministre doit effectuer des paiements aux hôpitaux fédéraux situés au Québec pour les services assurés fournis à des résidents conformément aux termes de toute entente intervenue à cet effet.21.Tout centre hospitalier privé doit fournir les services énumérés au paragraphe « de l'article 3.sauf ceux des sous-paragraphes vii et viii.S'il ne dispose pas des installations pour fournir tous les services prévus au paragraphe iii de l'article 3.il doit prendre les arrangements nécessaires pour que ces services soient fournis ailleurs, à ses frais, et il doit assumer les frais de transport.In the cases not provided for in subparagraphs a, b and c of the first paragraph, where a resident is cared for in a hospital centre situated outside Canada, the Minister shall reimburse a maximum of $25.00 per day to such resident or on his behalf.17.The reimbursements prescribed in sections 15 and 16 arc made only with respect to services provided by a recognized establishment accredited as hospital or hospital centre by the competent authorities to which such establishment is responsible: no reimbursement shall be made for a stay in a nursing home, spa or other similar shelter.18.Required reports: The general manager of every hospital centre shall forward to the Minister, on the form prescribed in Schedule A.a report on every person admitted to such centre within 4 days of his discharge or death.lî>.The general manager of every hospital centre shall forward to the Minister, on the form prescribed in Schedule B.a report on every person admitted to a hospital centre to receive therein the services Jisted in subparagraphs i to ix of paragraph b of section 3.This report must be forwarded to the Minister within 4 days from the furnishing of the service.20.The Minister shall make payments to the Federal hospitals situated in Quebec for insured services provided to residents in accordance with the terms and conditions of any agreement concluded to this effect.21.Every private hospital centre shall provide the services listed in paragraph a of section 3.with the exception of those stipulated in subparagraphs vii and viii.If it does not have the necessary facilities to provide all the services prescribed in subparagraph iii of section 3.it must take measures to ensure that these services are furnished elsewhere, at its own expense, and must assume the transportation costs therefor.
