Renfrew, Jim Donohue whose background is in car Centre regrouping Aylmer, Lucerne, Deschênes, LuskviUe, sales with Donohue Motors Ltd.at Renfrew, and Martin Burns Quyon, Onslow, needs public cooperation and participation in who hails from County Down, Ireland and has been in Renfrew order to set up its services, for seventeen years.Along with everyone else in the organization, these three all take their turns on the air.You can hear Terry and Jim on Easy Listening between ten and midnight through the week and Jim also comes on during the Saturday afternoon programs.Martin can be heard each morning from six to ten as he starts the day with his \u201cTop o' the Mornin* \" show.Three heads are better than one .The Department of Roads in the County of Pontiac Temiscaming has been granted $177,775.00.The Quebec Minister of Transport, Mr Raymond Mailloux, has granted a contract, to the amount of $177,775.00, to Kidd & Sons Company Limited, Chapeau, for roadwork in the electoral district of Pontiac Temiscaming.Our member of the National Assembly, Mr Larivière says that this contract has been granted for earthwork and gravel on Old Route No 8, district of Allumette Island for a distance of 1.89 mile.The Department of Social Affairs of Quebec, created the LCSC ( bill 65 december 1971) in order to answer the needs of 1 he people in health and social services.Consequently, the public is called upon to nominate candidates who will truly work with other members of the Provisional Committee.Public elections of the Provisional Committee will be held in St Paul Church, 61 to the way some people interpreted the Thorne Council Minutes in last week\u2019s Equity, Wally Bretzlaff does have a grocery license to sell beer.This good news was never sent to this paper until last week when Mrs Bretzlaff called to let us know and to point out to us the mistake in our headline.The headline was written on the basis of a resolution in Council, as recorded by the secretary, that the \"population does not warrant another outlet at present\".The question had been brought to Council, according to the minutes, by Mr Bretzlaff, and councils reply was indeed for Wally Bretzlaff, and the resolution did state that Ladysmith was not ready to approve the license.However Mr Bretzlaff, whose own license has already been granted, was meeting council with regard to another person\u2019s application.It was then that the council replied that the population did not warrant a third permit at the present time.So as things stand now, there are two licenses in Ladysmith: at the hotel and at Bretzlaffs store.We are sorry for the confusion set up by our headline last week, with only one suggestion for all secretary-treasurers in future.Quite often the minutes as recorded are quite dear to all who attended the meeting but not so clear to those who didn\u2019t.Since these minutes are the only official record of what happens at these meetings of elected representatives of the people using the public funds to administer the public affairs, they should be made clear enough for anyone to understand.(These minutes are published in THE EQUITY for any Pontiac County Municipality at no charge as a public service by Pontiac Printshop Ltd.We do charge for the publishing of lengthy by laws, but the minutes go in free, as long as we can afford it.If your own municipal council is not taking advantage of this free service, you might wish to ask them to do so.Most councils and school boards like the public to know what they are doing, what their problems are, and how Assembly News comes over CKOB (dial 1400) at 7:50 a.m , 8:50 a.m.\tfor first reading the Quebec Association of Protestant\tSchool 12Æ0 p.xu., 6 p.m.and 10 pan.with Paul Robinson, who always\tBoards has been actively engaged in a detailed study\tof the finishes off with sports.Paul studied radio at Canadore College\tlegislation and especially those sections which\tmight in North Bay and hails from Manitoulin, on Georgian Bay.\tprejudicially effect educational rights and the use\tof the English language in Quebec through actions of the Government considered to be ultra vires of its powers and in contravention of the rights of Canadian citizens both Francophone and Anglophone.Following the adoption of the Bill into law on July 31,1974 a further study in depth was undertaken by the legal counsel, Mr R J Stocks, on behalf of the Association and to assist in the deliberations the services of four (à) Constitutional experts were authorized, namely: Frank R Scott,Q.C., Peter M Lang Q.C., Jean Martineau C.R., J.Palmer Howard Q.C.The study and the recommendations of legal counsel have been received and it has been concluded that sufficient grounds exist to attach the constitutionality of certain sections of the Bill.The same recommendations would apply to the possibly unconstitutionality of certain sections of Bills 71 and 27 and to certain regulations issued under the provisions of the Bills.circumstances, this procedure might well be the first course to adopt.It would publicize across Canada the main objections to the legislation.However, the Prime Minister of Canada has recently declared publicly through T V., and the press that:- a)\tHe would not favour a petition for disallowance; b)\tThere will be no reference by Federal authority to the Supreme Court of Canada; c)\tAny court action to be taken should come from members of the public who are directly concerned.2)\tA Petition for a reference case to the Supreme Court of Canada:- This, like item (1) seems now to be ruled out by the Prime Minister.We have considered this as a possible course of action, but have rejected it due to the likelihood that all of the questions submitted to the Supreme Court would be forumulated by the Federal Cabinet.Such questions would not necessarily cover the subject matter which you would wish to have considered by the court.3)\tSome form of court action by interested members of the public:- This would include interested individuals, public bodies (including denominational school boards) and corporations.Conclusion: In the light of these considerations, we have concluded that the best procedure would be a Motion for Declaratory Judgment under Article 453 seq of the Code of Civil Procedure of Quebec.This article reads as follows: 4)\t.Any person who has an interest in having determined immediately, for the solution of a genuine problem, either his status or any right, power or obligation which he may have under a contract, will or any other written instrument, statute, order in council, or resolution or by-law of a municipal corporation, may, by motion to the court, ask for a declaratory judgment in that regard.\u201d Such a motion itself presents a difficulty because the courts have sometimes been reluctant to entertain such proceedings if any other type of court action is available.Either party could appeal from the Quebec Superior Court (where such a motion would be taken) to the Quebec Court of Appeal.An appeal would lie from this Court to the Supreme Court of Canada if the latter court should decide to grant leave.The only other type of court action we can envisage is one where the constitutionality of the Bill in whole or in part arises incidentally in an ordinary action between a plaintiff and a defendant.For example, at this very moment, a case is pending arising from a possible conflict between Bill 22 and the Federal Divorce Act.This type of case would be the preferable method to contest the Bills, but it is difficult to predict when appropriate cases might arise that would cover the questions which you would want to have adjudicated.In our consideration of Bill 22 so far undertaken, we conclude that sufficient grounds exist to attack the constitutionality of certain sections of the Bill.We are further of the opinion that should a decision be taken to contest these sections, then certain parts of the Act to Promote School Development on the Island of Montreal.(Bill 71 setting up the Island Council, etc.) should alsp be attacked at the same time (though not necessarily in the same action.) Specifically, we refer to those sections which purport to vest sole taxing power and budgetary control in the Island Council; this being a matter already dealt with in the opinion letter of Mr T P Howard, Q.C.which is dated March 8th, 1973, and is addressed to Dr L P Patterson, who was then the Chairman of the P.S.B.G.M.The same would apply to the possibly unconstitutional sections of Bill 27, as set out in the opinion letters addressed to Mr K W Musgrove dated April 22nd, 1971 and May 7th, 1971, We feel that any contestation of Bill 22 should stand by itself and should not be cluttered up with matters relating to Bills 71 and 27 appropriate plaintiffs or petitioners.Coming directly to Bill 22, we have considered various courses of action.These may be summarized as follows:-1) A petition for disallowance by the Governor Gener&l:-This procedure would have to be lodged within a year of the date when this Bill received Royal assent.In other É V/ It is necessary to point out that the opinion reports of the lawyers were made on behalf of the QAPSB and that the release of the documents to other interested parties will only be made at the discretion of the Officers of the Association.As a result of the meeting of the general membership of QAPSB held Saturday, October 19th at which the results of the study were presented the following recommendations have been accepted and which will form the basic policy of the Association relative to the report of the legal counsel.Such matters should be taken separately by \u2018A* Gail Griffiths calls herself the Womens Editor, but actually she is the creative genius behind much of what you hear over CKOB.Gail is an artist by training and experience, lives near Renfrew with her helicopter pilot husband and two children, writes copy for the station, produces commercials and is on air from ten to noon daily on \u201cSay it with Music\u201d, as well as the Community Bulletin Board, Social Notes, and also News for and about Women\".« -a - »!; A pi ' 1 7 FT it a k m * < « * ¦m, / \\ ?^ V } ! 1 11 m J r à M * « i V i Jay Silver is the Program Director for CKOB, coming to Renfrew from a stint at CHOV Pembroke and other related experience on a daily newspaper and radio in Montreal, radio in Quebec City and so forth.He achieved some fame as a man The voice you hear the most over CKOB is that of Scott Richards, Music Director, Disk Jockey, Technical Operator and Man on the Spot from ten to four every day.He hams it up with Gail, makes announcements, takes requests, and* .\tI .\t.,\t.obviously has a real good time doing it all.Scott is just as good who could 8^et in anywhere and in fact was once interviewed on matured as ht sounds and is absolutely unflappable and the Elwood Glover Luncheon Date in that connection.As completely at home with the mikes.A couple of special shows Program Director in Renfrew.Jay hopes to provide some good mam Maureen is studying for her BA.Degree.\tPeople with things to sell or trade.\tRequest Line.And starting this week there should be some Pontiac County notes coming over CKOB at about ten minutes after ten every Wednesday morning.Anyway, that\u2019s the plan.If it happens, and you like it, and if you tell them so, it might continue and expand to the point where \"The Renfrew Sound\u201d will also include \"The Pontiac Sound\u201d.(Meanwhile, over CHOV-TV Channel 5.Pembroke, at 11:30 p.m.every Sunday, the new show \u201cPontiac Now\u201d is attracting a little more attention each week.Anyone with a good idea for the show, or a word of encouragement, is invited to send \u2022 note to PONTIAC NOW.CHOV-TV, Pembroke, Ontario.) / III I# Sunday, October 27 SHAWVILLE JUNIORS mi OTTAWA MUSTANCS i # ? 4 Wednesday, October 23, 1974 Page 2 THE EQUITY The BauiTY JV Time for furs WEDDING INVITATIONS %
