Merchants were very competent to speak.He | would take as an illustration the case of a broker who had a quantity of wheat to dispose of, and I who shewed buyers a small part of it to indicate the well, I will take it as such,\u201d the sale would clearly have been one by sample.But on the other hand, if Holmes had said, \u201c here is a specimen of the genet al qaaltlt/\" as in the present case, the sale could not, according to the books, have been one by sample.This was the rule which the Jury ought to adopt.There was no sale by sample.Here facts and law were closely blended together.This fourth count contained no imputations of fraud, and if under it the Plaintiffs should be found entitled to recover, the damages ought to be small \u2014merely the measure of difference in value between the good article and the had.There was still another form iu which this claim might have been urged.If a purchaser bought from another, both parties being in good faith, and subsequently detected defects in the thing purchased, the law gave him the right to come back upon his vendor ; this was the case of a latent ace.But this ground of action was different from any set Up here ; and it was a matter of difficulty to say whether or not, under the declaration, it could be made available.The declaration was a long one, but he had great doubts whether it covered this ground.It would be better, however, to take it for the present as if it did so, reserving the point of law for further consideration.He confessed that he thought this fifth ground gave the plaintiffs a more substantial hope than any other, unless a fraud were proved.Here the liability of the vendor depended upon the defects being latent, and not patent ; for if a vice were patent, the purchaser, by a proper examination, could detect it.But where a vice was too latent to be discovered on examination, the law came to the aid of the buyer.In the present case.Holmes had replied to Gilmour\u2019s inquiries, that he had pork branded New York Inspected Mess.It had been shown by the evidence, that the pork had been previously branded as New York Inspected, and that part of it was re-inspected at the instance of the plaintiffs.\u2014 The fact was well established that the reinspection was subsequent to the sale.With certain barrels taken indiscriminately from the lot, Gilmour had declared himself satisfied.Then with respect to the others, which were not opened, the question arose, whether any defect they might have contained, was to be considered as latent, when, by the mere opening, it would have been rendered patent.No such defect could be called latent, in the proper sense.But to render the defect patent, it was not sufficient merely to un-head the barrels ; they had to be unpacked, and the Pork inspected, piece by piece.Now, as far as the purchaser himself was concerned, it was moraly impossible for him to do this.But the law made provision for the difficulty, by the appointment of a public officer, whose duty was to examine and certify the quality.In the present case, did the inspection subsequent to the sale vary the relation of the parties ?It was Gilmour\u2019s undoubted right to look at every barrel and at every piece.This, however, he could not do himself; but as there was an officer who could, and who was authorized to do so, he was willing to take that officer\u2019s statement.He, therefore, waived his right of personal inspection, in favor of another\u2014the licensed inspector.If this point were established, (and his Honor thought it was,) there was an end of all discussion as to the quality of the Pork.The rule would be different, if the defect were proved to have been latent, in the true sense, and not so merely because the barrels were not opened.He repeated, that the evidence was with the defendants, as to the Pork\u2019s being inspected after the sale, and at the instance of the plaintiffs.It did not alter the matter, that the defendants had paid the inspector, for they had done so at the election of the plaintiffs, and charged them with the amount.It would be perfectly apparent to mercantile men, that there must be some end to the liability of innocent vendors.He spoke of the hardship to which consignees would be subjected, who, after they had remitted the proceeds of sales to their principals, and the whole transaction had been long finished, should be suddenly called to account on their own behalf for recently discovered vices in the things disposed of.If, in this case, the Jury thought with him that the vice complained of was not latent, then, upon this ground, their verdict must be against the plaintiffs.But if they thought it latent, or thought a fraud to have been proved, his reasoning would not apply.There was another question incidentally connected with these points.Did the Montreal inspection cover that portion of the New York which was not reinspected ?He thought it did.Gilmour had thought proper to have a certain quantity inspected, to satisfy him as to the condition and quality of the whole.This, however, was rather a matter for the opinion of the Jury.His Honor, in concluding, said, that as the decision would be an important one, he thought, for the convenience of taking future steps upon it, if any should be found necessary, that the verdict ought to be special\u2014mentioning the counts upon which it was found\u2014if found for the plaintiffs ; if for the defendants, it would of course be general.The Jury retired, and after remaining in consultation for upwards of an hour, came into Court and stated they were unable to agree, being six to six.The Court having said that the case was one which might very properly be submitted to the Board of Trade, a juror was withdrawn and the jury were thereupon discharged.New York, June 23.The steamer Arctic arrived yesterday at 2 p.m., with 100 passengers, and four days later news.Cotton closed firm.Liverpool imports of Gram and Flour from Ireland and Coastwise this week are again trivial, while the exports increase, and since Tuesday embrace 4500 quarters Wheat; 5150 barrels and 1250 casks Flour; 18,100 quarters Indian Corn, and 918 brls Indian Meal.Where any change has occurred, it has been in favor of sellers.The price of every article has improved.The advance since this day sen\u2019night may be called 2d.per bushel on Wheat, and Od.(cv Is.per barrel on Flour one penny on Oats per bushel, and 6d.on Oatmeal ; Indian Corn Is.per quarter\u2014Is.per quarter on Peas and Beans.Several large purchases in Wheat and Flour to-day, to go some distance in the interior, which is an important and new feature to us, and indicates thus early before the harvest, thatjthere are Liverpool, June 7.Ashes.\u2014About 400 barrels have been sold during the last fortnight, at 27s to 27s 6d for Pots, and 29s to 30s per cwt for Pearl.Corn\u2014The week following our last report of the 24th nit., there was rather more business passing in Wheat at slightly improved prices ; in Flour several low sales were made, and for Indian Corn there was a steady demand at the quotations.During the past week there has been a steady consumptive demand for Wheat, and a fair business, passing in Flour ; in Indian Corn a reduction of 6d to Is per quarter was submitted to.At yesterday\u2019s Market there was a fair attendance and a good business done, Indian Corn having nearly recovered the depression of the past few days ; at the close there was a firmer tone for all articles than for some time past.Staves\u2014The better descriptions of hhd and wine Pipe meet ready sale, while the inferiçr kinds are neglected; good New Orleans hhd command £17 to £18 per M;\" New
