[" VOLUME XV.\u2014 No.26.MONDAY, APRIL 2, 1838.THE QUEBEC GAZETTE.Province of Lower Canada.COLBORNE.By His Excellency Lieutenant General SiR JOHN CoLBORNE, Knight Grand Cross of the Most Honorable Military Order of the Bath, and of the Royal Hanoverian Guelphic Order, Commander of HER MAJesTY\u2019s Forces in the Provinces of Lower Canada and Upper Canada, and Administrator of the Government of the said Province of Lower Canada, &c.&c.&c.To all to whom these presents shall come\u2014 GREETING :\u2014 A PROCLAMATION.YY HERFAS by the ninth Chapter of the Statute of the l\u2019arjament of the United Kingdom of Great Britain and [reland, intituled, \u2018\u201c An Act to make temporary provision for the Government of Lower Canada,\u201d passed in the First year of the Reign of Our Sovereign Lady the QUEEN VICTORIA, it is among other things enacted, that the said Act shall be proclaimed by the Governor of the said Province of Lower Canada, within the said province, and shall commence and take effect, within the said province, from the Proclamation thereof ;\u2014And whereas it is further enacted in and by the said Act of Parliament, that, for the purpose of that Act, any person authorized to execute the Commission of Governor cf the Province of Lower Canada, shall be taker to be the Governor thereof; And whereas I, the said Str Joan CoLBoRNE, have been and am duly authorized and empowered by Our Sovereign Lady the Queen to execute the Commission of Governor of the said Province of Lower Canada ;\u2014Now THERE- rore Know YE that I, the said SIR JoHN CoLBORNE,being authorized to execute the Commission of Governor within the said province, by virtue of the Power and Authority reposed in Me by Her Majesty, and of the said Act of the said Parliament, do, by this Proclamation, proclaim the said Act of the said Parliament of the United Kingdom of Great Britain and Ireland, so that the said Act of the said Parliament shall and may commence and take effect, within the said Province, from the day of the date of these presents, Given under my Hand and Seal at Arms, at the Government House, in the City of Montreal, in the Province of Lower Canada, the tweuty- seventh day of March, in the year of our Lord, one thousand eight hundred and thirty- eight, aud in the first year of Her Majesty's Reign.By 1lis Excellency\u2019s Command, D.DALY, Secretary of the Province.remanent ANNO PRIMO VICTORIA REGIN Æ CAP.1X.An Act to make temporary Provision for the Government of Lower Cunada.10th February, 1838.HEREAS in the present State of the Province of Lower Canada the House of Assembly of the said Province, coustitut- ed under the Act passed ia the Thirty-first Year of His Majesty King George the Third, intituled, An Act to repeal certain Parts of an Act passed in the Fourteenth Year of His Majesty's Reign, intituled, \u2018An Act for making ¢ more effectual Provision for the Government * of the Province of Quebec in North Ame- * rica,\u2019 and to make further Provision for the Government of the said Province, cannot be called together without serious Detriment to the Interests of the said Province, by reason whereof the Government of the said Province caunot be duly administered according to the Provisions of the said Act: And whereas it is expedient to make temporary Provision for the Goverument of MG, HL e, 31 TO SUPPLEMENT [New Series.) be enabled, after mature Deliberation, to make permanent Arrangements for the Constitution and Government of the said Province upon such a Basis as may best secure the Rights and Liberties, and promote the Interests of all Classes of Her Majesty's Subjects in the said Province : Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commous, in this present Parliament assembled, and by the Authority of the sume, That from the Proclamation of this Act in the said Province as herein-after provided, uatil the First Day of November in the Year One thousand eight hundred und forty, so much of the said Act of the \u2018Fhirty-firet Year of King George the Third, and of any other Act or Acts of Parliament, as eohstitutes or provides for the Constitution or calling of a Legislative Council or Legislative Assembly for the Province of Lower Canada,or as confers any Powers or Functions upon the said Legislative Council and Legislative Assembly, or either of those Bodies, shall cease and be of no force.The Powers of the present Legislature of Lower Canada suspended.II.And be it enacted, That it shall be lawful for Her Majesty, by any Commission or Commissions to be from time to time Her Majesty may appoint a special Council 1 ff .5 d i for the A Cu issued under the Great Seal of the United nada.Kingdom, or by any lustructions under Her Majesty\u2019s Siguet and Sign Manual, and with the Advice of Her Privy Council, to constitute a Special Council for the Affairs of Lower Canada, and ior that Purpose to appoint or authorize the Governor of the Province of Lower Canada to appoint such aud so many Special Councillors as to Her Majesty shall seem meet, and fo make such Provision as to Her Majesty shall seem meet for the Removal, Suspension, or Resignation of all or any such Councillors: Provided always, that no Member of the said Special Council shall be permitted to sit or to vote therein until he shall have taken and subscribed before the Governor of the Province of Lower Canada, or before some Person authorized by the said Governor to admis pister such Oath, the same Oath which is now required to be taken by the Members of the Legislative Council and Assembly before sitting or voting therein respectively.Members of the Council to take au Qath.111, And be it enacted, That from and after such Proclamation as aforesaid, and , ; until the said First Day of November in the andCouncilmay Year One thousand eight hundred and Ordinances for forty, it shall be lawful tor the Governor of the Government the Province of Lower Canada, with the ada.\u201c® Advice and Consent of the Majority of the said Councillors present at a Meeting or Meetings to be for that Purpose from Time to Time convened by the Governor of the said Province, to make such Laws or Ordinances for the Peace, Welfare, and good Government of the said Province ol Lower Canada as the Legislature of Lower Canada as now constituted is empowered tv make ; and that all Laws or Ordinances so made, subject to the Provisions herein after contained for Disallowance thereof by Her Majesty, shall bave the like Force and Effect as Laws passed before the passing of this Act by the Legislative Council and As sembly of the said Province of Lower Canada, and assented to by Her Majesty, or in Her Majesty\u2019s Name by the Governor ofthe said Province : Provided always, that no such Law or Ordinance shall be made unless the same shall have been first proposed by the said Governor for adoption by the Council, nor unless the said Governor and Five at least of the said Councillors Limiting their shall be actually present when such Law or Duration.Ordinance shall be made: Provided also that nolaw orOrdinance so made shallcontinuein force beyond theFirstDay of November in the Year One thousand eight hundred and torty-two, unless continued by competent Proviso as to Authority : Provided also, that it shail not imposing Tuxes.he lawful by any such Law or Ordinance to impose any Tax, Duty, Rate, or lmpost, save only in so far as any Tax, Duty, Rate, or Impost which at the passing of this Act is payable within the said Province may be thereby continued : Provided also, that it afteor the ext.Shall not be lawful, by any such Law or ing Laws respect.Ordinance, to aiter in any respect the Law ing Rights of now existing iu the said Province respecting Election, &es the Constitution or Composition of the Legislative Assembly thereof, or respecting the hight of any Person to vote at the Llection of any Member of the said Assembly, or respecting the Qualifications of suchV outers, vrrespecting the Division of the said Province into Counties, Cities, aud Towns fur \"The Governor Such Laws (o be proposed by the Govervor.Laws or Ordi- nuances not to Lower Canada, in order that Parliament may | the Purpuse of such Elections ; LUNDI, AVRIL 2, 1838._ be lawful by any such Law or Ordinance to repeal, suspend, or alter any Provision of any Act of the Parliament of Great Britain, or of the parliament of the United Kingdom, or of any Act of the Legislature of Lower Canada as now constituted, repealing or altering any such Act of Parliament.No Law or 1V.Provided always, and be it enacted, Ordinances to That it shall not be lawful by any such Law or appropriate the Ordinance to appropriate any Moneys which for Hepaymont now are or which shall hereafter be in the ofthe Sum of Hands of the Receiver General of the said Z1260duniens Province of Lower Cunadu towards the Reno veriiicate of payment of any Sum or Sums of Money which of Tremere shall have been issued out of the Sum of One hundred and forty-two thousand one hundred and sixty Pounds Fourteen Shillings and Sixpence granted to Her Majesty by an Act pas- nor to an sed in the last Session of Parliament for Ad- amount exceed- vances on account of Charges for the Admi- WE ibe apres nistration of Justice and of the Civil Govern- priat \u2018ment of the Province of Lower Canada, unless upon a Certificate from three or more of the Commissioners of Her Majesty's Treasury, setting forth the several Sums which shall have been so advanced for any of the Purposes aforesaid .Provided also, that.exclusive of any such Repayment as aforesaid, no Appropriation to be made by any such Law or Ordinance of the Moneys aforesaid in respect of the Public Service for any One Year shall exceed the total Amount of the Sums appropriated by Law within the said Province for the Public Service thereof for the Year One thousand eight hundred and thirty-two.V.And be it enacted, That the Governor of the said Province is hereby required by the first convenient Opportunity to transmit to One of Her Majesty's Principal Secretaries of State an authentic Copy of every Law or Ordinance made under the Authority of this Act ; and that it shall be lawful, at any Time within Two Years after such Law or Ordinance shall have been so received by such Secretary of State, for Her Majesty, Her Heirs or Succes sors, by Her or Their Order in Council, to declare Her or Their Disallowances of such Law or Ordinance ; session du Parlement, pour avances à compte des dépenses pour l\u2019admi- nistratiou de la justice et du gouvernement ia civil de la Province du Bas-Canada, à moins un monfant que ce ne soit sur un certificat de troi dhs exeedera les plus des Commissaires de la Trésorerie de sa 1892, Majesté énonçant les diverses sommes qui auront été ainsi avancées pour aucuu des objets susdits: Pourvu aussi que, à part de tout remboursement tel que susdit, les allocations qui seront faites par une telle loi ou ordonnance, pour le service public, à même tels deniers, n\u2019exeédant pas, pour une année, le montant total des sommes allouées par la loi dans la dite Province, pour le service public d'icelle, pour l\u2019an mil-huit-cent-trente- deux.Les Lois ou Or- V.Et qu\u2019il soit statué, que le gouverneur donnances pour-de la dite Province est par le présent requis tos ar ga de transmettre à l\u2019un des principaux Secré- Majesté eu son aires d'Etat de Sa Majesté, par la première Conseil, occasion convenable, une copie authentique de toute loi ou ordonnance faite sous l\u2019autorité de cet Acte ; et qu'il sera loisible a Sa Majesté, ses héritiers et successeurs, en tout temps dans les deux années à cumpter de la réception de telle loi on ordonnance par tel Secrétaire dE\u2018tat, de déclarer, par son ordre ou leur ordre en conseil, son désaveu ou leur désaveu de telle loi ou ordonnance;
