Hutchinson ' rendered judgment in several Superior Court cases this forenoon., LC Dame Helene Lachance vs.Francois Roberge.—This was a motion made ty the defendant for peremption. Some time ago the plaintiff took an action in the Superior Court to com- Pel the defendant to render an account, or in default of go doing that he pay her the sum of $600.The court gave judgment in plaintiff’s favor and ordered the defendant to give-an accounting or pay the sum sued for within so many days. After this the plaintiff ‘consented to a delay in the filing of the account, but [reserved her right to contest the same. That was two years ago, an the defendant now prays that he be granted peremption, and that proceedings he terminated. The Court held that the defendant had not complied with the judgment of the court, and the consent of the attorney in the case was beyond his mandate and without effect. The motion was dismissed.: " SUED FOR RENT.Rene Lysee was sued at the instance of J.O.Archambault et al., heirs of the estate of the late J.A.Archambault, for $100 as rent of Bellmont Farm, in Ascot. The - de- fondant pleaded that the late J.A.Archambault was owing him a greater ‘amount than that.sued for, and pleaded compensation. In answer to this the plaintiffs said that the defendant is owing the estate a large sum of money for rent and for notes now in their possession. The Court held that the allegations of the plaintiffs were well founded, and condemned the defendant to pay the sum sued for with interest and costs.Co | OWNERSHIP OF FARM IN DIS- 1 PUTE, E.X.Somers vs.W.Beaudette and J.©.Archambault et al., opposants, and the plaintiff contestant.—This is an action that arose through a seizure put on the property situated in Orford, and which at that time was supposed to belong to Peaudette. The plaintiff claims that Beaudette had- always been recognized as the proprietor of the said farm, and that his name appeared as such on the books of the municipality. The heirs of the late 'J.A.Archambault op-’ posed the seizure of the property, as they claimed it belonged to ‘the estate. It was further contended that the plaintiff Somers had made an abandonment of his vious to the said seizure, and that the curators of the abandoned estate of the plaintiff. The property, it was claimed, was acquired by the late J.A.Archambault in August, 1891, and that the defendant Beaudette never owned the property. The Court held that the plaintift’s rights under the said judgment passed -to his creditors, and he had no legal right to proceed to justify the said judgment. It was also proven in the evidence that Beaudette had left the district in the fall of 1904, and that plaintiff was-aware that defendant did not own the property at the time he took out the writ seizure.‘The property was offered for sale for school taxes, but it was redeemed by the said opposants. The opinion of the Court was that the cpposition was Well founded, and dismissed the contestation off the.plaintiff with costs, and annulled the seizure and set aside all the proceedings had and taken in the case.ACTION FOR DAMAGES DISMIS ED.Oliva Lacharite vs.A.Trudeau.— ‘Both the parties are from Windsor Mills. The plaintiff sued the defendant for $5,000 damages, which he alleged he sustained through having to have his leg amputated as a result of an accident in the defendant's mill. The plaintiff claimed that when he was at work at a lath machine on the 26th of May, 1908, the belt came off the pulley, and when he went below to put it on he was caught and his leg broken in three places, so that it had to be amputated ahove tlie knee.He contended that the-accident was caused S- the defendant and his employees. On the other hand the defendant pleaded that he was not responsible for the accident, but that it was caused through the plaintiff's own fault in not stopping the machinery when about to put the belt on.The defendant further swore that he had oun told the plaintiff that if he with costs.“ re "SPIKED HIMSELF TO CROSS.San Bernardino, Cal, May While brooding over - the death of King Edward.al Frene- M ; .« ç are injurious to the business in more “ways than one.In the first place the refrigerator ‘car is not intended to supply, the place of cold storage at creameries. Its function is to preserve properly cooled butter in.the same condition as when received, until it reachies the buyer in the distant city or town.Butter not properly cooled put into a refrigerator car raises the temperature of the the quality of the whole shipment.1 This practice, we are glad to say, is becoming less every year, owing to the government or the railway refusing to take butter on these.cars unless properly cooled. It becomes necessary therefore for every creamery to put in proper cold: storage facilities. The Dominion Gover nment, through the Dairy Commissioner’s Branch, grants a bonus of $100 to every creamery erecting a cold storage, - the plans of which comply with the regulations laid ‘down by the department.Plans and mery cold storage are furnished by | the Dairy Commissioper’s Branch, + though the bonus 1s sometimes paid for other ‘constructions, provided they ire equally as good as the .- recommended.that time -
