Mr.Connaughton, the aspirant for alder- manic honors in St.Ann's Ward, was not entitled, according to the city charter, to Le a candidate on the grounds that he was an expropriation commis- sloner for the widening of Notre Dame street west, According to the charter an employee of the city cannot be a candidate.The paragraph in the charter referring to this reads as follows: \u2014\u2018 No one shall be a candidate who bas any contract with the city for the performance of any work or duly, or is surety for gny such work or contract.\u2019 These who are epposing Mr.Connaugh- ton claim that this clause applies to expropriation commissioners, A \u2018 Witness ' reporter visited the expropriation department and found that Mr.Connaughton had been an expropriation commissioner but that his MURDER.MR.ARCHAMBAULT TALKS ABOUT THE CASE\u2014 A SCENE IN COURT, There was no afternoon session of the Demers enquete, yesterday, as the witnesses who were to have testified on that occasion failed to turn up.The investi- gatlon was consequentiy adjourned until THs .merning.The first witness called was George Maheu, carriage maker, who was a fellow workman of Demers at Latimer's car- ringe factory.He testified that on the morning of June 13, when he arrived at the factory at seven o'cleck, he found Demers already there.He was dressed in a gray suit.He saw Damers several brother when he came to fetch him in the afternnon.Demers lent him a knife about a month before the murder.Never saw anything out of the way in Demers's demeanor.After the murder Demers said that he could not understand why they suspected him.Witness knew that Mrs.Demers was jealous of Mrs.Proteau.Miss Donalda Demers, sister of Napoleon Demers, of St.Charles, was the next witness, She testified that she learned of the death cf her sister-in-law the night after the murder.She came right on to Montrea! and met her brother Oscar at the station, who told her that his brother\u2019s wife had eut her threat.Witness asked him: \u2018 Did she hersclf cut her threat ?\u2019 Her brother did not answer her.Witness spent some days on a visit to Napoleon Demers\u2019's house last May and she never witnessed a quarrel between the deceased and her Lusband, and did not see him drunk.When the body was sent to St.Charles witness accompanied her brother thither.The latter brought with him a tie and a white shirt.Amcng the goods brought Ly those who went to St.Charles was a pair of drawers belonging to Napoleon Demers.Vitness did not sce a single drop of blood en them; there were some black stains which anpeared to have been made by dust.Witness did not ask her brother how his wife died nor did he teil her anything about it.Cross-examined by Mr.Desmarais, wil- ness said that during her five weeks\u2019 visit to Demers\u2019s house, she never saw her brother got into a passion.Doralda Demers is probably the last witness tho Crown will call to give cvi- dence regarding tha case.To-merrow, Doctors Villeneuve, Fafard end Johnson will give evileitce of a technical nature as to whether the stains on certain articles found in Demers's house are those nf blood or of some cther substance.This will close the case for the Crown, after which Mr.Desmarais will make his pea! Bfforis in behalf (Ë the defence.To a \u2018 Witnrss' reporter this morning, Mr.Arehambault.for the Crown, said:\u2014 \u2018I have been found fault with by some outsiders on the score that I go too much int» minute details; that I am only delaying the case by asking questions which are of no importance.Now, I am boun] to go into the smallest details of this case because, according to the new eri- minal code, the preliminary investigation \u20ac at times during the morning, and saw his | of a case before a magistrate to-day is a different thing from what it used to be.Now it takes the form of a complete trial, the defence has a right to bring up any number of witnesses and to make as full a defence for his client as he can, and, consequently, I have to leave no stone unturned by which I might secure the holding of the guilty party or his discovery at least.This Demers case is of so grave a charac\u2018er, and so important, that it is plainly my duty to take all the legal means in my power to find the guilty one, and when that is done, I will leave to the Magistrate to settle with the prisoner.I hope that I am conducting the Investigation with impartiality; I am acting according to my bost judgment, and in a spirit of justice and equity.\u2019 A little scene which was quite impressive and touching whi it lasted, occurred in the court room just after the ccurt adjourned.During fre\u2019éntire time that Miss Donalda Demers was in the ecurt room she never so much as once was notlcad to give a glance towards her brother, the accused, nor was he, apparently, aware cf her presence in the room.They hoth knew of each other's presence too well, however.After she had testified and was dismissed Miss Donalda asked permission cf Mr.Archambault to speak to her brother.Mr.Archambauit raid that he was unable to grant her per- sion.An expression of pain and disappointment spread over the girl's pallid face.her large, over-bright eyes drcopei to the ground and a suppressed sigh shook her fragile frame.Mr.Archam- bault addad, however, that if the judge thought fit that he could allow her to speak a few words to the prisoner.On being appealed to Judge Desnoyers gave the desired permission, and the girl turn- irg threw her arms around her brother's neck, pulled his face down to hers and kissed him tenderly.Even Demers's steel nerva and self-control could not withstand this display of affection; it was probably the first genuine sympathy tha had reached him since the day hisFwife was found murdered, and it overcame him.and lowering his face he cred.As his tears fell a spectator happened to notice him and remarked, \u2018There lcok at Demers!
