the learned judge held that while It wag true, as argued, that the question of a plot was a matter for the police authorities to take up and investigate, on the other hand it was evident that the City Council had the right to inquire if its officials were guilty of the alleged conspiracy. There was no direct charge agains.the two officers, it is true, but the City Council, having deemed it advisable to investigate even an indirect charge, the court could not Intervene, especially in view of the fact that the parties interested did not complain, and no one protested agaist the investigation. As regards the second point, His Lordship found that the investigation committee had exceeded their powers.Quoting the doctrine laid down by Spedding that the injunction extends to restrain abuses of discretion such ca as to evince an intention to resort to | arbitrary exercises of powers, he found such arbitrary intention to appear in the mayor's declaration that the investigation was not limited to Dr.Laberge and Inspector Grand- champ, but practically extended to the whole lodge. His Lordship then referred to the numerous illegal questions put to wit- nesscs, such as the following: ‘Is the lodge composed of Nationalists?‘Are there any judges therein?‘Are there any lawyers?” ‘Are there any journalists” ‘Under the oath which you have given, you did not know that there was a recorder in the lodge?‘All those facts,” the learned judge said, ‘show the court that the members of the committee attempted to make of such investigation committee ‘ All | a kind of Inquisition tribunal.this would not have occurred had the city entrusted its legal advisers wi*h the care of conducting the proceedings.’ His Lordship then remarked that the committee having declared, through the city attorneys, that the investigation was closed, there was no practical use for an injunction, ag what had already been done could not be prevented. It was agreed, however, that the court should prevent the committee from making a report, such report being useless, anyhow, as no plot had | been shown to exist. On this point the learned judge ruled as follows:: ‘The court having found that the committee could nvestigate the conduct of the officers of the city, cannot, it strkes me, logically prevent said committee from making report.Besides, the court Is convinced that, in said report, the committee will strictly linit themselves to the queston submitted.’ he final conclusions of the judgment were then given out as follows: “Whereas counsel for petitioner have expressed their fear that the investigation might be continued by other parties notwithstanding the declaration made before the tribunal, the court decides to suspend its decision on the present petition for a period of | one month so as to give time to the Investigation committee to make their report to the city meanwhile. The court reserves adjudication on the question of costs until after that date.’ $50 FOR A KISS Young Man Alleges fieifans i stable Demanded Black mail, "Rifty dollars a kiss is altogether too nfch of a good thing, according to “ge complaint of a young man, made That is why a unt Royal Park constable has been ‘fro elucidate further, the young man ‘forementioned was walking through ie park with a young lady last Sun- ‘Fiy.and kissed her.The constable ireatened him with arrest.ale J oung man didn't want the girl to be taken to the police station, and offered the constable money to allow tiem to go.The latter refused 3.0, $20.330 and $40, but accepted when it tame to $50.The constable in question claims to nave evidence that will prove that n> did not see the complainant at the time and place stated on Sunday. In tie meantime he has been suspended.PLOT WAS WIDESPREAD.Revolutionists in Portugal Becoming Active.-isbon, September 21, via the fron- tlor.—The seizure of a bomb factory resterday followed the discovery of a widespread anti-monarchial plot, with &vret ramifications throughout Por- “Ugal. The ‘Imparcial,’ an official or- Zan, serves notice to the conspirators hat although liberal, the Government i: prepared to crush mercilessly any revolt, ————— FARMER WAS KILLED.Coaticook, Sept.21.—While William Norris, a farmer of Dixville, wag driving a team of horses while under the infinence of liquor, his waggon tip- ‘pi’ nver and he landed on his head, rearing his neck.-—_ + * NEW SERIES.+ —— * COUPON No.3.+ _—_ + : WEDNESDAY, SEPT.21.+ —_— + ; September 21.—At the close of the police court proceedings to-day Dr.Hzwley H.Crippen and Ethel Clare Le Neve were committed for trial, charged with the murder of the doctor's wife, Belle Elmore.Solicitor Newton reserved his defence for the trial proper.Miss Le Neve was hooted and jeered to-day by a crowd of men and women that awaited her arrival at the Bow- street police court. The inquiry in the case of Miss Le Neve and Dr.Crippen for the murder of the latter's wife was drawing to a close, and this fact probably accounted for the unusual number of persons who gathered the vicinity for a possible view( of the prisoners.A group of women followed the cab occupied by the accused girl, through the streets to the police court, velling their opinjons of the typist as they chased along. When the vehicle stopped in front of the court building, a crowd.that filled the thoroughfares 1 hooted derisively.Miss Le Neve held an open umbrella before her face, and was fairly successful in escaping observation as the police made way for her.The financial affairs of the Crip- pens were gone into to-day in line with the prosecutor's opening assertion that the doctor at the time of Belle Elmore’'s disappearance was pressed for funds, and that the death 01 the woman would be ‘> the monetary advantage of the husband. The manager of a bank testified that Mrs.Crippen notified the institution on December 15, 1909.of the withdrawal of a joint account which she and Crippen had kept there.Miss Merion Curnow, an employee of the Munyon people, who succeeded Crippen in the management of their local office, testified that the poison alleged to have been purchased by the doctor and traces of which were found in the mutilated body, was not used by the company. She added, however, that Crippen frequently bought drugs for his own preparations. The witness said that during February, when Crippen told her that his wife had gone to America and died there, she cashed for him several cheques, one for $500.She last saw the doctor on July 9, when she gave him the money on a cheque for $185.This was just before he disappeared, and at the time he said to witness, ‘If anyone inquires for me you are to know nothing; say nothing. Before this Crippen had left several packages with the witness, saying, ‘If anything happens to me, give these to Miss Le Neve.William Long, In giving evidence, stated that Crippen called at Munyons early on July 9th.He seemed to be troubled, and Long asked him what was the matter.Crippen replied, ‘Only a decide in one of course for the way, and that is M.S.R.directorate’s contentons.duwever, the iirst nand-to-hand round in ine dispute may not be peost- poned until the annual meeting in No- vemuer, if a usually well-informed broker has the correct information. He tells us that a special meeting of the Montreal Street Railway shareholders may be called for early in Oc- toner, when the proposition for an amaigamation between the Montreal Stree.Railway and the Montreal Light, Heat x Power Company will be sub- niitied and passed upon.As no shareholders will be permitted to vote at that meeeting who has not a clear sixty days title, it will mean neo douvt that considerable of the stock and proxies acquired by the Canadian Power people for voting at the No- vemuer general meeting will be out of court, und that the Montreal Street Hailway-Montreal Light, Heat & Power merger proposition may carry easily. In that event, what are the Canadian rower people likely go do ?Our adviser, who ha« handled a good deal oi the stock which has passeu in these transaciions, and who is assured that the Fuwer people have held a majority.of the Montreal Street Railway stock for November voting purposes, even if they do not do so now, is inclined to think that the Canadian Power people will show their strength at the Montreal Street Railway annual meeting, vote down whatever has been done against them, and go to the courts with evidence that they really held the preponderance of stock while the scratch vote against them was carried. One is almost inclined to exclaim with Sheridan in ‘The Rivals'—The quarrel is a very pretty one as it stands; we should only spoil it by trying to explain it.’ However, the public is entitled to know how the quarrel stands, and to be warned that in buying Power today on weak margins ît is skating—if the simile is adequate—on thin ice. For, supposing the merger to be a fait accompli at 250, and 190, what will it mean to the public from an income point of view! Well, about five percent net is the idea, and there are many better propositions than that on the market now, which are going quietly along without any fuss being made about them._ The rest of the market was very firm, with practically every active stock enjoying an advance and these were many.————t———t——— New York, Sept.21.— Transactions is the case, rhere should be a good market for stocks-also., The uiter lack of response to bad news is the principal market feature. For an instance, on the announcement that the United States Government woula attack the American Sugar Kefining Company, there were only 700 shares of this stock dealt in at a decline of 11% percent, and, strange to say, ‘he preferred stock on the same emotions than those two, until the very end.Until the mention of that name-—‘Perry Hunter But at the sound of that name— just then, the girl saw his face go bloodless, not all at once, slowly, rather. And then after a little while he uttered a great sob; not of grief, but such a sob as both the Fanshaws had heard before, when, in battle or skirmish, a soft-nosed bullet smashes its way through some great, knotted nerve centre. His hands went out in a convulsive gesture, both the stick and the dart which he held, falling from them, the stick at the girl's feet, the dart at his own. Then leaning ‘back against the rail for support, he covered his face with his hands. At last, while they waited silently, he drew himself up straight and looked dazedly into her face.other two men, she crossed the deck to where he stood.‘I'm perfectly sure, for my part, that you didn’t do it: that you are not the murderer of Mr.Hunter.Won't you shake hands?| He made no move to what their intent was, guessed that it was something sinister, it was done before I could interfere.I saw him going backwards over the brnk of a | fissure in the .ice, tugging at a dart that was in first time, in nine years of activity, the association has met in annual session west of Winnipeg.’ Mr.Henry, the president, told the delegates in yesterday's first session of the Manufacturers’ convention. Two special trains brought 300 delegates from the East, while some 200 from all.parts of British Columbia joined ‘them here in what promised to be one of the most important of the association’s meetings. The first convention | day wag marked by an able and exhaustive address by Mr.Henry, in which he made ‘a vigorous plea for continuance of preferential tariff in favor of the Old Country and the colonies, the desirability of Canada preserving the right she now exercises of making her own trade treaties, and strongly opposed reciprocity with the United States. The address was the feature of a brief first day's session, at which the commercial intelligence department recommended that an advertising campaign for ‘made in Canada’ goods be instituted and carried on by extensive advertising.By the expenditure of $25,000 annually a circulation of eighteen million could be covered and good work done. The committee advised that large Abandoned by Police.Havelock, Ont., Sept.21.—A new and dramatic situation in the Belmont township mystery developed yesterday afternoon, when Hugh Delaine was arrested here by Provincial Constable Reburn on the charge of murdering ais wife. The arrest was made without trouble, Delaine submitting quietly and without any statement. He will be taken to Peterboro jall until Friday, when he will be called to give evidence at the inquest.According to statements made by the authorities here they have no tangible evidence on which to base the arrest, but some important evidence which it is expected will make a strong case against Delaine will be given at the inquest. The tramp theory has bean discarded for the present.Arccording ‘to neighbors of the De- laines, Delaine made repeated statements that he would go home some night and find his wife dead.Delaine and his wife were illiterate, desperate- -ly poor and shiftless.Delaine’s spasms seemed to verge on insanity and he had periods of distress when he would froth ‘at the mouth. These all incline the neighbors in the belief that he was subject to epileptic fits.Their lonely life away from friends of any kind, devoid of all social intercourse and ‘the little that is known about either of them all seems to lend color to the supposition that Delaine, unknown to most people, was an epileptic.A point that it is thought will be in Delaine’s favor is that according to Dr.Holdcroft, who made the post-mortem examination, there were signs of an attempt at outrage, but the murde-or evidently failed in his Better Progress With the Promised Improvements.Montreal is the ‘mother’ city.Notre Dame de Grace Is her Ireland. Its citizens have tasted the sweets of self- government but were brought Into subjection to Montreal against the will of many of them. The result is there is a group of ‘home-rulers’ in the sunset ward, and they are far from satisfied with the adgninistration under the new conditions. To air their views and strengthen the hands of their representative in the City Council, ex-Mayor George Marcil, a meeting was held in the old town hall last evening, which was presided over by Mr.Dugald Macdonald, and attended by about foriy ratepayers, who claimed to represent the ward.Their speches revealed a large number of grievances and an earnestn-2ss born of deep personal interest in the matters discussed. The wide contrast between promise and fulfilment was one of the phases of the post-annexs- tion administration that was emphasized. The situation was mygle the subject of witty comment by some of the speakers, but a strong tincture of sarcasm was mingled with all prescriptions for the betterment of the body politic. The climax to the deliberations was ALD.GEORGE MARCIL.in the form of a resolution presented by Mr.Scott Stevenson, manager of the St.Henri branch of the Merchants Bank, seconded by Mr.John Macdonald. It was as follows: ‘Resolved, In view of the terms of annexation and the time already passed; also the ralsing of the valuation in Notre Dame de Grace; ‘That our representative, Mr.George Marcil, be instructed to bring to tho notice of the Board of Control at once the necessity of livizig up to the terras of the contract made by the city of Montreal and Notre Dame de Grace; and that the question of toll gates, electric lighting, street car, police, fire and water services be taken up and settled at once, and definite replies he.given our representative on these subjects for our information. This resolution was carried with only one dissenting voice, one ratepayer expressing the fear that if they went before the Controllers asking for so many things their valuation, which had already been.doubled, would be raised still highex next year.‘The chairman of the meeting, in opening the proceedings, remarked that thére was no doubt that in the matter of annexation the city of Montreal had secured: the long end of the stick. The ward had not yet obtained all the benefits: it had a right to expect, but perhaps it was too soon yet to condemn the new system of administration adopted by the city or to blame the Controllers for deficiencies that might be pointed out.As for the ‘ocal representative, they were not assembled to find fault with him, but to assure him of their support in his efforts to secure the-improvements so much needed.in the town.Tue city by forcibly annexing Notre Dame de Grace, and the Quebec Legislature by making such annexation possible, had set an example that no civic or legiglative bodies should copy in the future. In doing this they committed an act of folly, but it had been done and the public were compelled Lo make the best of it as law abiding citizens. But they should stand on their rights and maintain their liberties, and if the Board of Control did not do right by ‘them they must elect Controllers who would.PAPERS THEIR BEST FRIENDS.By way of suggesting means of securing the fulfillment of pre-annexa- tion promises some counselled going to law and others going to Quebec; but Mr.Marcil advised agitation.‘We ‘have mo legal redress,” he declared, ‘but we can get what we are entitled to by agitation. The papers are our best friends.Mr.Marcil explained a great many things that the ratepayers asked questions about, the principal statement being that when he asked the Controllers for anything they always replied: ‘We have no money; vou must wait for the next appropriations.’ He explained the reason why the col! gate had not yet been abolished and why the street railway line had not heen extended along the Upper La- chine road.He stated that owing to a mistake in the works department of the old council a sewer placed in the north side of Sherbrooke street was so shallow that it would not drain the south side.He said the representatives of the newly anmexed municipall- ties had formed a caucus to look after their interests in the City Council.Mr.John Macdonald sald his valuation had been increased $1,500 this year, and he was anxious to know whether he could have his lots designated as farm lamds so as to lower the rate of taxation.Mr.Robert Brodie.said he had read that the city had had its debt Increased by $5,000,000 through annexation. He did not see any cause for complaint seeing the valuation of this one ward had been doubled, being now $8,000,000.Another citizen complained that he had received from the city treasurar's department an account for water rates whereas there was no water service within 150 yards of his property. He was thinking of notifying the author!- ties to ‘cut off’ the imaginary supply.Mr.Brodie, said that recently three men entered his orchard, and when ordered off threatened his man with revolvers. One of them, when arrested, had two revolvers on him.He was fined $15, which Mr.Brodie considered was not of much effect as a deterrent.: The meeting terminated with the passing of the above mentioned resolution.THE MONTREAL DAILY WITNESS, WEDNESDAY, SEPTEMBER Zi, 1910 MRS, FRANCIS ACQUITTED Judge Leet Found no Evidence to at $16.30, was heard in chambers by Judge Leet on Monday. The judge considered that the evidence showed the complainant was aware that her ticket was being held at collateral for a debt of $5 claimed by Mrs.Francis, and that there was nothing to prove that it had been taken from her by force; he, therefore, dismissed the charge of theft.Buf, as the Guild oficers stated that they had destroyed the agreément which the girl! had signed, and upon which the claim for $5 was made, the judge ordered that the disputed ticket be returned to the complainant: without the payment of $5, and made no order as to costs.LORD CLINTON HERE.Has Nothing to Say About His Rumored Investments.~ Lord Clinton, D.L, {wenty-first Baron, who came from England two months ago on his way to the West for a trip, was in circulated reports that these gentlemen were preparing to make huge investments In the West, and that not least of the proposed projects attributed to them was the initiation of another transcontinental railway.Lord Clinton, this morning, had nothing definite to say as to the precise object of his journey to the Dominion, or as to what business arrangements had been completed, but he suggested that a good deal of the statements printed as to the railway matter and other affairs of less magnitude was quite unwarranted.Lord Clinton said he had had a most enjoyable trip in every way,
