There: was not much to be added, he re- | marked, to.what had already been said in favor, of the accused. After reading the in- “dictmient Mr.Devlin said that al} the jury had to consider Res what way cGRlis ras oa licated | pn pe x its Drneld 7 eo wis charged “with makleg out Ti ware- houtte receipts. There was not enough in the admissions alleged to have been made by McGlilis to prove him guilty. There was no prool that McGillis made out.either the warehouse receipts or the stubs. There was rot a particle of conclusive proof of this.Mr.D.M.Stewart was shown certain waré- house receipts and asked as to the hand- amid - Gillis's handwritthg. The same in respect to the stubs.Stewart never swore to it This was the weakest point in the Crown's case. The Crown knew they could not bring the charge home to MeGillis. Before the jury could condemn a man to seven yéars in the penitentiary, they must be certain that the evidence against him was more than the ‘I think’ of a witness. The Crown did not question Messrs.Ramsay, Brock or Singleton as to McGillis's handwriting. The Crown knew that Chisholm was too deeply implicated in these frauds, The Crown put the question to none of -these witnesses, It had subpoenaed A.D.MeGillis to prove this three times and had not examined him.Beyond Stewart's evidence the Crown had none against MeGillis. It had failed in every Instance. He (Mr.’Devlin) had asked John F.Mullin to MoGillis's handwriting on-the stubs.M uiin could not say.He did say that both .Chishelm’s and McGillis’s handwriting were much alike.Chisholm could have writ- ot a stud and McGliilis a warebouse receipt.’- Chisholm ¢ould get McGillis to write nut.the warehouse receipts and fill up the stubs himself.Mr.Devlin then spoke of the evidence given by Mr.Snetsinger as to MeGlllis's ,good chardcter, which was so high during a period of twenty-four years, and.proceeded.to show how, when MeGillis came to Montreal, he came under the influences of.CHisholm and bad to obey the orders of the latter.Out of these transactions had it been prov ed that McGillis got one cent?Had anyonb stated that he had añy bank account?Ir McGillis were kn@w- ingly a party to any conspiracy would he not häve-benefited by it?Mr.Devlin then traced the manner ip ‘which Chisholm had carried out thé dis- eounting of the notes, Showing how McGillis had been deceived by.Chisholm.Even supposing :McGillis could have made out a stub, he sald it was essay for Chisholm to have said that he would go to the bank and correct a warehouse receipt when the latter was incorrect. When Chisholm told him he (Mollie) had committed these frauds, the latter was ready to sacrifice himself for the Mullins, for whom he had great affection.Mr.Devlin further showed that McGillis wad ready to say how sorry he waz that .bis.name appeared in the warehouse re- cefpis in a civil, not a criminal sense. All be, did say was that bis name appeared there as did Mullin’s.Chisholm was too careful.to- let his nume appear on any cheques.Chisholm when Ke found McGillis wayid not help him out of the mess gave MeGWilis two black eyes as & reward for his faithful services. It was plsin that in all thésé transactions Chishetm was the guilty party. The Influence that Chigholm had oyer McGillls was ii strong that he Mr.St.Pierre, the other counsel for McGillis, proceeded to address the jury in French. The leerned counsel spoke much to the same effect as had Mr.Devlin.After dwelling on the seriousness of the Jury's duty, he spoke of the highly respectable character of the accused, which was supported so strongly by the witnesses from Ontario, mentioned by Mr.Devlin, and the certainty of the latter's honesty given by Mr.Patrick Mullin, Mr.Wm.Nivin and others.Mr.St.Pierre then reviewed Chisholm's connection with McGillis, showing how great was the power of the former over the latter.transeetions with thaf ‘bénks, Chisholm had alone profited.Me- ‘Gillis’s admissions, Mr.St.Pierre consider- ‘ed, were made solely.through -Chishoim’s influence over him.He conciuded with a powerful appeal to the jury for the acquittal of his.client.In this, he said, they would be displeasing some people, but they would be restoring two fathers to thelr weeping children, and would be rendering, not mercy,, for that was not asked for, but justice, Justice, Justice. The Court then adjourned until the &f- on Tuesday.IN THE AFTERNOON, THE JUDGE SUMS UP—FURTHER ADDRESSES OF COUNSEL.When the Court of Queen's Bench reassembled for the afternoon session yesterday, Mr.J.P.Cooke commenced his address to the jury on behalf of the Crown in the Cold Storage trial. The learned counsel, after expressing his opinion that the defence had gone too far in attacking the character of tlie Crown witnesses, proceeded to prove to the jury that the Crown had fully proved its case.In regard to the guilt or innocence of the prisoners, Mr.Cooke drew attention to McCullough's evidence, and the difference between the same, and that of the Crown witnesses.McCullough, said the learned councel, bad utterly falled to prove that the cheece transactions were for Chisholm’s benefit. If there was any reasonable doubt, the prisoners should have the benefit of it, but if not, the jury must put on one side feelings of pity, and render & verdict according to their consciences.Mr.Casgrain, speaking in French, followed in a similar strain.McCullough’s testimony, he remarked in the course of his speech, was direct evidence of a con-, spiracy.Mr.dustice Hall commenced his chacwe |.to the jury at precisely 4.30.After ves markig thas he evidence Thi the.Suse max.Ja e 0! © cas Lx.carbe , the in the issue of fraudulent.warehouse receipts.Ke learned judge proceeded to review the various facts in connection with Mec- Gillis's case. Not much weight should be attached to the admissions made by Mec- Gillis, except so far as they concerned himeelf.“In regard to the defence of Mc- Gillis—the influence that Chisholm had over the accused—His Honor held that the the person influenced must be held responsible for having yielded to the other. In regard to McCullough'e case, the learned judge remarked that the defence of the accused "was very plausible. It was for the jury to say whether there was sufficient evidence to show that a business entered into in good faith by McCullough, became so changed that he was not as innocent as before. There were some things about it which were suspicious, and in this connection His Honor went on to refer to the statement of McCullough to the bank that, at the request of Campbell, Shearer & Co., his company was buying cheese for them, never telling the bank that the business was Chisholm’s.His Honor then referred to the cheques and the duplicate invoices. Not one of the latter contained either the name of Chisholm or his initials. There was Also | no ledger account in the business, which was also.very remarkable. His Honor also referred to the admissions of the accused sworn to by Messrs.Ramsay and Stewart, and the question of the prisoners’s good characters, remarking ‘that men of good chardeter were ¢hiefly those selected to carry out frauds of this kind.He ther told the jury they must give the prisohers the benefit of any reasonable doubt, if any, existed, and, after briefly addressing them in French to the same effect, dismissed them to consider their verdict. The jury were out for city has limited these to fifty, you will easily understand why tha: city can boast of having finer restaurans and.cafes than we have.A great number of these shop licenses here are obtained for the purpose of selling liquor by the glass in a back room. This 1s certainly unfair competition to the hotel trade of Montreal, and I claim that the Government shouid limit these licenses to a reasonable number.’ THE TARIFF READJUSTMENT ‘I stated in my last manifesto, that we would appeal to the federal Government for the readjustment of the tariff on wines and spirits. This statement was government proposes to call for new tenders for the canal contract. We have no information on the subject and without more reason than has been alleged anywhere we must assume the rumor to be false. The reason given is that the lowest tender has been made by a num- Der of practical contractors snd the next e, considerably higher, by a group of persons appearing under & company name.‘but understood to- be “Politicians.‘The latter would not presumably be personally the menagers of the work, but would look’ to get it as a favor and to make something out of it.in the calculations they have made we have no means of judging. There are few better able to judge than themselves. They presumably .count on making money by it.If they have carried out all the conditions af the tenders called for and put up the right cash security it would seem simple injustice to them to call for new tenders after their figures have been opened. The only relief to the situation that could result from such a course would be for some of the other group to tendër lower, or for them to tender higher. In the latter case’ they should He the people asking for new tenders and not their rivale. In ‘the’ former the objection that the work could not be done for that money would be proved to be hollow. Why no award is made after | the caution money has been six weeks Vaal River Colony, when, at the St.Andrew’s dinner, he announced the policy henceforth, not only of the new colony but of the British Empire, to be that of a nation in arms as against that of a great standing army. The time is past when a nation can treat fighting in the offhand way of hiring # done by professionals. This may serve in the case of border skirmishes, but less and less will nations go to war on anything but life and death struggles. In every case the invaded nation at least will need to be a nation of soldiers. The Dutch have taught us that & netion of riflemen is wel nigh invincible at the hands of invaders.Let a country like Switzerland have an army of half a million trained riflemen and artierymen ‘apd who will dare to The same of Canada. As Governor McKenzie says, the result is that the people can comfortably pursue their industries without fear of interruption.Canada has ner- haps less reason than any other cour:try on earth, to fear interruption, but it would do her no harm, would not be terribly costly, and would be entirely wholesome if every boy should learn at school how to obey the word of command, to shoot straight with a rifle, and how to ride a ‘horse. The first of these acquirements, that of obedience and respect, is perbaps he lesson our rising generation most needs to-day «for its moral well-being and that of the nations ———— PRINCE EDWARD ISLAND'S PECULIAR LEGISLATURE.The Conservatives of Prince Edward Island are evidently much less disheartened by the result of the Dominion eléde- tions than the Conservatives of this province.Though the Conservatives, having polled a popular vote in Quebec of ninety-one thousand, are by no means weak, and have no reason for despair, yet the position of the Conservatives of Prince Edward Island couraging than theirs, for in Prince, Bdward Island a majority of the] vers degaçer| ft recount, however, has resulted in the return of one Liberal in place of & Conservative declared elected by a returning officer, so that a majority of Liberal members have been finally returned.Unlike the Conservatives of Quebec, those of Prince Edward Island are making a fight for the parliamentary existence of their party, and perhaps even for viotory. They have put up candidates in every constituency of the island, save one.In the second dis triot of Prince county both the Liberal Legislative Councillor and the Liberal Assemblyman have been elected by acclamation.“Both represented the dis trict in the late legislature. In all other of which elects a councillor and an assemblyman, the Opposition have put up ‘candidates against the government, The election of legislative councillors spoken of above is an interesting peculiarity of the province of Prince Edward Island.Up to 1804 the legislature of the province was one of two houses, a council answering, like the Senate, to the House of Lords, end an'‘essemtily answering to the House of Commons. The little house of lords was cumbersome, making legislation much mare difficult and more costly. In acoordance with the example of Ontario, which never had 4 legislative council, byt only a single chamber, and was the best governed province, the other provinces tried to rid themselves of upper chambers.New Brunswick wholly succeeded, Prince Edward ‘Island partially ewoceeded, and Nova Scotia and Quebec whôlly failed. The abolition of the conncils needed the: consent Of the councillors, which was given by those of New Hrinswick, promised, but-not fulfilled, by those of Nova by position, rights and powers of the councillors and the assemblymen are the same ; absolute equality in every respect exists inside of the Assembly. The effect is simply an amalgamation of the two old houses. The intereste of property owners are eup- posed to be protected by the presence of their special representatives in the Assembly.FOR THE SICK CHILDREN.(To the Editor of the ‘Witness.’) Sir,—Will you kindly permit me, 4 through your columns, to make an appeal to the benevolent and charitably- disposed of this city, at this season, in behadf of some sick children who, I fear, might be overlooked because excluded from the eye of the ‘public: I know that the little ones in the General and Royal Viétoria hospitals will have all their childhood hopes realized on Christmas day.I would like to be equally assured that the poor little sufferers in the Civic Hospital will not be forgotten. There are from forty to sixty children in this hospital, who are not permitted to see their own mothers or friends.‘Any contributions of toys or dainties to gladden their hearts, sent to 170 Elgin street, will be delivered to them on Ohristmas day by the hospital chaplain.E.McMANUS.Loan?Elgin street, Montreal, Dec.5, THAT CHINESE MISSION.(To the Editor of the ‘Witness.’) Sir, —A paragraph appeared in last evening’s ‘Witness’ regarding the Chinese Free Mission which is very misleading. There is no such mission under Christian auspices. The Presbyterian Church has for years maintained a large and successful mission among the Chinese of Montreal, under the charge of the Rev.J.Thomson, M.D.Two congregations of other churches have Sabbath ‘schools attended by Chinamen, Apart from these, there is no Chinese mission in our city.Further, the Chinamen have never been a charge upon the charity thrifty class of men, and seldom is there one in need of help. When help is required their clansmen come to their relief, and Europeans need.not be anxious lest they should suffer from want.A LOSS TO THE PROHIBITION PARLIAMENTARY PARTY.Mr.James McMullen has Teosived the following letter from Mr.T.B.Flint, M.P.for Yarmouth, N.S., the leader of the prohibitiondsts in parliament: ‘1 noted with deep regret the result of the election in your constituency and beg to express my sincere sympathy with you at your defeat.Although, as a matter of personal concern, I do not suppose a seat in parliament is a profitable matter for a business man, yet to one who has for so ‘a period Toronto.-~-We would value a few remarks from ¥ou ‘on the subject of floor coverings and’ other decorative modes of making a home heälthtul, eomfortable and pleasant.A carpet on: the floor is, I understand, condemned on the adore of being unhealthy, which = decidedly of utmost importance.Ans.—The best way to treat the floors throughout a house is to stop all nai} holes, crxcks and crevices with putty, stain the floor with an oil or water stain, but preferably ofl, size over once or twice and varnish with two-eoats of hard drying .varnish.Rugs, or carpet squeres with borders and beaten only oncé or twice a year.Lingiqums.are perhaps next desirable, but even these are to a certain extent porous and fequire disinfecting and cleansing very frequently. There is no doubt but that the painted and polished -floor (or stained: and varnished) is the:most sanitary covering, because it does.not absorb germs and the surface is easily | cleansed efficiently. If the whole of the floor The bridge over the Red river, which has long been a necessity, will put the finishing stroke to the work, and the line will be one of the wonders of the world for solidity when the length of the system is taken into account. This work has been carried out concurrently with the building of branch lines in British Columbia, which work is also about completed, and which cost in the neighborhood of five million dollars. The company is ready to start fresh spurs when the further development of the mining industry warrants such undertaking.Theres is no finality to a sys tem like the C,P.R., but the completion of the main line is a source of gratification to the management.Under the direction of Sir William Van Horne the work went steadily forward, but during the past five years extra efforts have been made, and larger sums expended, in laying down new eighty-pound rails, building iron and steel bridges aud stone calverts, for the position of the com- ny was assured, and the object of Sir William Van Horne was to evolve a system which should be modern and up- to-date in every respect, his theory having always been that to make business you must never be afraid to spend money.m2 A MODEL NEWSPAPER.LONDON CLERGYMAN TO TEACH THE BRITISH PUBLIC HOW IT SHOULD BE RUN.London, Dec.5—The editor of the ‘Sun,’ an afternoon halfpenny paper, will hand over the editorship of that journal from Dec.17 to Dec.22 to the Rev.Joseph Parker, pastor of the City Temple, who will emulate the Rev.Mr.Sheldon, whe for ‘a time conducted the Pépeka ‘Capital’ Mr.Parker will have the en- It is announced that he will show Briti 3 ists and ¢he-British public how; standpoint, he hoped the disparities possibly existing in the laws of the different states would be remedied, but as chancellor his first duty was not to allow the federal character of the empire and the autonomy of the members of the federation to be prejudiced without the consent of the individual states.INVASION OF ENGLAND.LONDON PRESS TREAT MERCIER'S SPEECH WITH CONTEMPT, London, on behalf of the United States government. It is difficult to gather the details of the understanding at this time. However, it is kñown that in the two important issues that were still open, namely, those relating to punishment and indemnity, the view of the United States government has prevailed. As to punishments, they are to be the severest that can be inflicted by the Chinese government. As to indemnity, the Chinese government is to formally admit liability, and then the matter is to be left for future negotiations. It was understood that on the other points the French proposition has fo the basis of agreement.Pekin, Dec.5.—At yesterday's meeting of the foreign envoys the main point and most of the argument concerned the question whether the joint note should be considered an regain his feet, but fell to the ground.Wound- ed as he was, he drew his revolver and covered the minister, now within ten feet of his fallen foe.Again Wohl fired and simultaneously with that shot, the gun in the hand of Stokes spoke. When the smoke cleared away the two men lay in their blood upon the sidewalk. The bullet had entered Stokes’s side below the heart, and passed entirely through the body.Mr.Wohl was recognized as one of the most forceful and eloquent Presbyterian ministers of this state.Mr.Stokes is an ex-Virgin- ian University president, and comes from one of the best families of Virginia.CONSERVATIVE CAUCUS, YESTERDAY'S GATHERING IN TORONTO.Toronto, Dec.5—The caucus of the Conservative members of the legislature and of the defeated candidates at the last provincial election, held here to-day on the call of Mr.J.P.Whitney, the Opposition leader, was attended by about eighty gentlemen. The principal matter under discussion was a proposal by Mr.J.W.Moyes, of East York, to hold a convention of provincial Conservatives for the purpose of formulating a platform for the coming general election.Mr.Moyes urged his view with persistence at the morning session, but he was called away to attend the death bed of his sister, and no ome took up his cause strongly, although a number of members were understood to favor the idea.Mr.Whitney stated that he was not convinced of the need of a convention at the present time at all events, and his view was accepted. At the close of the caucus the leader gave out a statement saying the gathering had been in every respect a satisfactory one, and the greatest good feeling prevailed.Members generally declared that the coming general elections would be fought by an enthusiastic and united body of supporters behind Mr.Whitney.The Conservative members of the Dominion House and the defeated candidates will meet to-day for a similar conference.SONS OF TEMPERANCE MEET — FIFTY-SECOND ANNUAL GATHERING IN ELEMENTS EXPLAINED BY PRINCIPAL GRANT.Toronto, Dec.6.—The making of Canada’ was the title of an entertaining talk by Principal Grant before the teachers, pupils and friends of the Normal School last night.Dr.Grant declared that a man could be made in a generation, but it took centuries to make a nation—a great, emduring nations that has added something permanent to the welfare of humanity.Canada, like the United States, would be a greater and richer nation because of the complexity of its Clements; because, it had -sprung om the two atest of e European races, the British and the French.The.term ‘French-Canadian,’ he thought an improper one.The people of Quebec never spoke of themselves as anything but Canadians. They were the oldest Canadians and the core of the Canadian people. One of the elements in the ing of Canada had been its citizen soldiery.Canada had taken part only in Wars to repel invasion. In the late etruggle she was fighting for the defence of the empire. Before the outbreak he (Principal Grant) had counselled patience with the.Boers, believing that the difficulties would be settled, but after their childishly insolent ultimatum, there was nothing more to be said.As yet the only method discovered to conduct responsible government was by the party system.Sir Richard Cartwright once called it war.So it was, but it was civilized war—sometimes.Civilized war meant that they were not to poison wells, but if they misrepresented the speech of an opponent in order to make out that he was stirring up racial and religious hatred, they were poisoning wells.—_—— TEMISCOUATA RAILWAY.Quebec, Dec.5—At the annual meeting of the Temiscouata Railway Com- any, held here yesterday, Mr.F.Brand was elected president, and the general manager, Mr.kett, announced that he was obliged to resign his position owing to other business; but he finally consented to act as manager until the end of the season.Pa PONIES.(London ‘Spectator.’) Sir Walter Gilbey, one of the best judges of domestic animals in Englamd, has -published two elegant little books cn ponies for use in war—‘Small horses in warfare’ and ‘Ponies, past and present’ (Vinton & Co., 2s.each).He is the owner of some of the best shire horses in England, and his hackney champion has just taken the prize as the finest ali- round horse in the world at the Paris exhibition, where the cosmopolitan crowd of Italians, French, Russians, Hurgarians and the rest, whose own horses had been beaten rose spontaneously to their feet, waviuy hats and handkerchiefs and shouting ‘Encore’ in four different languages, as the finest harness horse ever seen passed them in all the pride and display of its ‘ncom- parable action. But the possession which many people envy more than this is his pony ‘Rosewater,’ ilie most famous sire of polo ponies in the world.Speaking with the practical authority guaranteed by these successes as a breeder of horses of all sizes, the :uthor is convinced that for the use of our raount- ed infantry we must have a special breed of war ponies, or small horses.A cross of Arab blood with our native moor and forest ponies might, he thinks, give us the ideal animal for this kind of work. This view, which is probably correct, assumes that a pony is something different from a horse, and that it has quaji- | ties or capabilities of a kind which it can impart to the larger animal by crossing. In other words, a pony 1s not merely a small horse, which con subsist on rather less food than the larger breeds, but an animal in which a greater degree proportionately of strength, constitution, endurance, and perhaps intelligence, is concentrated and “nherited.Ignorance, which is defined at Grimsby as not to know a dab from a flcuncer, is supposed at Horncastle Fair to be embodied in the man who does not know a horse from a pony.Yet the question ‘What is a pony ?meets with no very certain answer. Those who go by the card take the mere rule of height, and say Res any animal under fourteen hands inches is a pony. That is the maximum height allowed in polo matches in .In India it is thirteen hands three inches. But many polo ponies are simply small thoroughbreds, with very little difference in points De- .tween them and the racing thorowrabred, except that they are older and more developed. The ideal polo pony has been defined as ‘a miniature thoroughbred steeplechaser,” which ig not a pony at all except that it can catry a heavier man for its size then a racehorse.Perhaps .the best means of forming an independent idea of what it is that confers om the pony the distinction of representing AB ferent.pe, ‘physically as well gs- tas ty, ie ims are ¥ nutiiber of-por- -{photgraplis ‘in .pro ( paing porses “of “various 5 the real ponies need for polo by hgf# weights, such as the Cairo ponies, which are not miniature Arabs, to the tiny Shetland winner at the last Crystal Palace Show, which only measures thirty- one and a half inches at the shoulder, the property of Lord Hopetoun’s sisters, the Ladies E.and D.Hope.A distinguishing mark of the pony is its head, which is usually shorter from the eye to the mose, and broader between the eyes, than that of the horse. The gro- file also shows a difference. In the horse the line of forehead and note is continuous, giving the expression which is meant when human beings are inelegantly said to have a face like a horse. The pony’s nose has usually a «light depression below the eyes, witre it leaves the forehead. The nose is sometimes almost a ‘turn-up,” with any amount of cheerful expression about it.Arab horses have often the same typ@ of nose. Some thoroughbreds show the same pro- file—‘La.Fleche’ has a regular pony nose —and many of the Suffolk Punches, which are the most pony-like of big horses, owing to their short legs, have the same.Ponies, as a class, are more compact in proportion to their size than ‘horses, and have shorter legs. The only point against them is that when not carefully bred they tend to revert “o the -wild type, and to become less suitable for riding.Their shoulders become lew- er and thicker.Pony shoulders are, in fact, rather a weak point.Looking to Nature for a match to the average pony, we find that he has very many of the points of the primitive horse.Burchell’s zebra, the commonest, species of South Africa, has many of the good points of the pony, and also mest of the bad ones.He is short in the back, medium-sized, but strong, with a regular pony head and profile. But he has a bad shoulder, and a short stride. All zebras are sure-footed in rough grourd, as ponies are, and like pon‘es they can gallop both up and down sleep and ‘mountainous slopes. But the ponies represent a ‘ater development than the zebras, and better natural powers. As animals are not really progressive, though by artificial selection their physique or mental capacity can be improved in certain directions, the pomies have often retained much that the horses have lost.‘ The mare of ar Arab chief, which lives daily with its master.is fed on little but wholesome food, and exists in nearly natural conditions, retains the qualities of endurange and intelligence, augmented by the purity of ‘its blood, and by slightly inc size. But the artifi- ciglly enlarged horse of Europe, which spends its life in the stable or in har ness, and supports its increased size by consuming greater quantities of artificial food, loses constitution, endurance end brains. It is not fair fo' our horses to compare them with the sharp-witted little ponies, because they are never given a chance to think for themselves. The tendency for generations has been fo make them into machines. That many of them retain the capacity for thinking and learning is proved by their cleverness when any one takes the trouble to teach them.Bat most, for want of teaching, develop the weakness of ignor- eg Boater yn x de Soci prick
